THE FACTS

The applicant is a Dutch citizen, born in 1950, and at present residing in Swalmen . In the proceedings before the Commission she is represented by Mr . H .J .J .M . van der Bruggen, a lawyer practising in Roermond . In March 1 978 the applicant became unfit to work as she was suffering from bone cancer . On 21 June 1 979 the Trade Association for Banking, Insurance, Wholesale and Liberal Professions (Bedrijfsvereniging voor Bank-en Vercekeringswezen, Groothandel en Vrije Beroepen) gave the applicant a right to disability benefits as of 31 March 1979 under the 1976 General Labour Disability Act (Algemene Arbeidsongeschiktheidswet) . On 20 April 1979 the applicant married as a result of which the aforementioned Trade Association on 13 July 1979 withdrew her disability benefits as of 20 April 1979 under Section 32 of the General Labour Disability Act which provided for the withdrawal of disability benefits of women upon marriage . In June 1980 the applicant separated from her husband and on 26 February 1981 the applicant was divorced from her husband by decision of the Regional Court (Arrondissementsrechtbank) of Roermond, which was entered in the Civil Register (Register van de Burgerlijke Stand) on 9 June 1981 . After her separation the applicant requested to be awarded disability benefits again but on 12 November 1980 the New General Trade Association (Nieuwe Algemene Bedrijfsvereniging) refused this since the applicant could not be considered to have eamed a sufficient income to be awarded disability benefits . On 8 December 1980 the applicant appealed against this decision . She argued that during the relevant period (i .e . 1977 until March 1978) she had been working for her present husband . As she and her present husband already intended to marry while she was working for him, this work had not been settled financially . Since she now intended to divorce her husband, the applicant wished to settle this matter . On 9 June 1982 the President of the Council of Appeal (Raad van Beroep) of Roermond rejected the applicant's appeal . The President found that the applicant had been looking after her own household (with three children) until March 1978, and had been receiving benefits from the Social Service (Sociale Dienst) of Swalmen since October 1976 . The Council also took the fact that the applicant had not been formally employed into account . The applicant did not lodge a further appeal (Verzet) against this decision of the President of the Council of Appeal, but on 19 November 1982 her lawyer requested the New General Trade Association to resume paying disability benefits to the applicant as of 9 June 1981 on the basis of Section 38 para . I of the old 1976 General Labour Disability Act, which provided that the right to disability benefits, withdrawn upon marriage, revived when the marriage came to an end .

On 8 February 1983, the Trade Association declared the applicant's request inadmissible on the ground that Section 38 para . I had been abrogated as of I January 1978 and had not been replaced by any similar provision . The applicant, subsequently, appealed against this decision to the Council of Appeal of Roermond on 28 February 1983 . The applicant argued that on the basis of the transitional provisions of the new General Labour Disability Act of 20 December 1979 . which, as regards the issues concerned, had been made retroactive until I January 1978, the new provisions were applicable in her case, which contained no provision on the basis of which her benefits would have been withdrawn upon marriage . Since the benefits were withdrawn solely because of the applicant's marriage they were not resumed upon her divorce under the new legislation . Therefore, the applicant concluded that either her right to benefits as of 13 July 1979 should be decided upon under the new legislation or the request to resume payment of the benefits should be considered under the old legislation . The applicant alleged that the interpretation of the transitional provisions by the Trade Association amounted to a discrimination on the basis of sex and was, as such, contrary to Article 14 of the Convention . On 29 May 1983 . the President of the Council of Appeal declared the applicant's appeal ill-founded . The President considered that, under Section IV para . 3 of the transitional provisions, the new legislation, effective as of 1 January 1978, was applicable to women who were married since I January 1979 . Since the applicant was married on that date she could not claim resumption of the payment of disability benefits under the old Section 38 para . l, because the new provisions were applicable in her case . Since the applicant could not claim resumption of the payment of disability benefits, the question arose whether she was eligible to be awarded disability benefits under the new legislation . However, since the applicant could not be considered to meet the income requirements laid down in Section 6 para . I (a) of the new Act, she was not eligible for disability benefits . As the President did not find any other reason to consider the litigious decision contrary to prevailing legislation he declared the applicant's appeal ill-founded without further investigation . The applicant appealed against this decision of the President of the Council of Appeal . She argued, inter alia, that, since she married after I January 1979, the provisions of the new Act became applicable to her retroactively . Therefore, these provisions were also applicable to her on 20 April 1979 . As of 20 April 1979, the new Act, however, does not provide for withdrawal of disability benefits becaus e 164
of marriage by a woman and, consequently, the decision by the Trade Association of 13 July 1979, to withdraw her benefits as of 20 April 1979 because of her marriage, was unjustified . However, on 20 May 1983, the Council of Appeal declared the applicant's appeal ill-founded . The Council held that not only Section 32 of the new Act was applicable to the applicant, but also Section 6, laying down income requirements, which the applicant failed to meet .
COMPLAINTS The applicant has complained that whilst the old (1976) General Labour Disability Act, which provided that women lost their disability benefits upon marriage, was contrary to Article 12 of the Convention, since this amounted to a sanction on the marriage of a woman, the interpre tation of the transitional provisions of the new General Labour Disability Act violated her rights under Article 12 of the Convention . Funhermore, the applicant has complained that this interpretation constituted a discriminatory difference in treatment between, in particular, married men and married women, contrary to the provisions of the Convention . In this respect, she has invoked Article 14 of the Convention, read in conjunction with Article I of Protocol No . I to the Convention and Anicle 12 of the Convention .
THE LAW (Extract )
2 . The applicant has complained that by withdrawing her benefits under the old Act and by not resuming them under the transitional provisions of the new Act,a sanction was placed on her marriage contrary to Article 12 of the Convention which provides : "Men and women of marriageable age have the right to marry and to found a family, according to the national laws goveming the exercise of this right . " However, the Commission considers that the applicant's ability to exercise her right to marry was not in any way interfered with by the withdrawal of her disability benefits and finds that the applicant's complaint in this respect must therefore be rejected under Article 27 para . 2 of the Convention as being incompatible ratione materiae with the provisions of the Convention . 3 . The applicant has funher complained that, since she is not now entitled to disability beneftts only because she is a woman who married, she has become th e 165
victim of discrimination contrary to Article 14 of the Convention, read in conjunction with Article 12 of the Convention and Article I of Protocol No . I of the Convention . Article 14 provides that : "The enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour . language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status . "
The Commission recalls that this provision has no independent existence but prohibits discrimination only with respect to the enjoyment of the rights and freedoms set forth in the Convention . It is true that the applicant has invoked Anicle 12 of the Convention and Article I of Protocol No . I in conjunction with Article 14 . However, as the Commission found above, the applicant's complaints under Article 12 fall outside the scope of the Convention and no issue, therefore, arises under that provision in conjunction with Article 14 of the Convention . The Commission has next examined the applicant's complaints under Article I of Protocol No . 1, and notes that the social security legislation concemed, viz . the General Labour Disability Act, is set up as a general insurance (Volksverzekering) based on the principle of social solidarity . No direct link exists between the level of contributions and the benefits awarded . Consequently, a person does not have, at any given moment, an identifiable and claimable share in the fund . Therefore, the Commission is of the opinion that in the above circumstances the right to benefits cannot be considered to constitute a propetty right which could be described as "possessions" within the meaning of Article I of Protocol No . I to the Convention . Accordingly . the applicant's complaints under Article I of Protocol No . I to the Convention must be rejected under Article 27 para . 2 of the Convention as being incompatible ratione mmeriae with the provisions of the Convention . It follows that the applicant's complaints under Anicle 14 of the Convention, read in conjunction with Article 12 of the Convention and Article I of Protocol No . I to the Convention must also be rejected as being incompatible ratione mareriae with the provisions of the Convention under Article 27 para . 2 of the Convention .

( 7'RADUCTlON) EN FAI T Le requérante est une ressortissante néerlandaise, née en 1950 et habitant actuellement Swalmen . Devant la Commission, elle est représentée par Me H .J .J .M . van der Bruggen, avocat à Roermond . En mars 1978, la requérante, atteinte d'un cancer des os, perdit son aptitude au travail . Le 21 juin 1979, l'Association professionnelle des banques et assurances, du commerce de gros et des travailleurs indépendants (Bdrijfsvereniging voor Bank-en Verzekeringswezen, Groothandel en Vrije Beroepen) lui reconnut le droit de percevoir une rente-invalidité à partir du 31 mars 1979 et ce, conformément à la loi générale sur l'incapacité de travail de 1976 (Algemene Arbeidsongeschiktheidswet) . Le 20 avril 1979, la requérante contracta mariage, sur quoi l'Association professionnelle susmentionnée lui retira, le 13 juillet 1979, la rente-invalidité avec rétroactivité au 20 avril 1979, conformément à l'article 32 de la loi générale sur l'incapacité de travail qui prévoit après mariage le retrait des prestations-invalidité versées aux femmes . En juin 1980, la requérante se sépara de son mari et en divorça le 26 février 1981, par jugement du tribunal régional (Arrondissementsrechtbank) de Roermond, dont mention fut portée le 9 juin 1981 sur le registre d'état civil (Register van de Burgerlijke Stand) . Après sa séparation, la requérante demanda à bénéficier à nouveau de la renteinvalidité, mais la nouvelle Association générale (Nieuwe Algemene Bedrijfsvereniging) la lui refusa le 12 novembre 1980, estimant que la requérante n'avait pas des revenus salariaux suffisants pour avoir droit aux prestations-invalidité . Le 8 décembre 1980, la requérante se pourvut contre cette décision, faisant valoir que, pendant la période en question (soit de 1977 à mars 1978), elle avait travaillé pour son conjoint . Comme elle et son mari actuel avaient déjà l'intention de se marier pendant qu'elle travaillait pour lui, ce travail n'avait pas fait l'objet d'un règlement financier . Comme elle envisageait à présent de divorcer, la requérante souhaitait régler cette question . Le 9 juin 1982, le Président de la commission de recours (Raad van Beroep) de Roermond rejeta le recours de la requérante . Il estima que la requérante s'était occupée de sa maisonnée (trois enfants) jusqu'en mars 1978 et avait perçu depuis octobre 1976 des allocations du service social (Sociale Dienst) de Swalmen . Le conseil tint compte également du fait que la requérante n'avait pas été formellement employée .

La requérante ne forma pas opposition (Verzet) contre cette décision du Président de la commission de recours, mais le 19 novembre 1982, son avocat demanda à la nouvelle Association professionnelle générale de reprendre le versement des prestations-invalidité à partir du 9 juin 1981 et ce, sur la base de l'article 38 par . I de l'ancienne loi générale sur l'incapacité de travail de 1976 qui prévoyait que le droit aux prestations-invalidité, retiré au moment du mariage de l'invalide, reprenait en cas de dissolution du couple . Le 8 février 1983 . l'Association professionnelle déclara irrecevable la demande de la requérante, l'article 38 par. I ayant été abrogé depuis le lef janvier 1978 et n'ayant été remplacé par aucune disposition analogue . La requérante forma un recours contre cette décision devant la commission de recours de Roermond le 28 février 1983 . Elle fit valoir que, sur la base des dispositions transitoires de la nouvelle loi générale sur l'incapacité de travail du 20 décembre 1979 qui, pour les questions soulevées, avait emporté rétroactivité au I° janvier 1978, les nouvelles dispositions lui étaient applicables et ne prévoyaient pas le retrait des prestations aprés mariage . Les prestations ayant été retirées uniquement en raison du mariage de la requérante, elles n'ont pas repris à son divorce compte tenu de la nouvelle législation . La requérante en concluait dès lors qu'il fallait soit décider de son droit au x prestations à partir du 13 juillet 1979 en vertu de la loi nouvelle, soit examiner sa demande de reprise du versement des prestations en vertu de l'ancienne loi . Elle alléguait que l'interprétation des dispositions transitoires par l'Association professionnelle constituait une discrimination fondée sur le sexe et était dès lors contraire à l'article 14 de la Convention . Le 29 mai 1983, le Président de la commission de recours déclara le recours mal fondé . Il estima qu'en vertu de l'article IV par . 3 des dispositions transitoires, la loi nouvelle, entrée en vigueur le I" janvier 1978, était applicable aux femntes qui étaient mariées depuis le I° janvier 1979 . Or . la requérante étant mariée à cette date . ne pouvait pas réclamer la reprise du versement des prestations-invalidité en vertu de l'ancien article 38 par . I puisque son cas relevait des nouvelles dispositions . Conime elle ne pouvait pas réclamer la reprise des versements, la question se posait de savoir si la nouvelle législation lui donnait droit aux prestations-invalidité . Cependant, comme elle ne remplissait pas les conditions salariales requises à l'article 6 par . I a) de la nouvelle loi . elle n'avait pas non plus droit à ces prestations . Le Président, ne trouvant aucun autre motif d'estimer la décision litigieuse contraire à la législation . déclara le recours de la requérante sans fondement .

L'intéressée interjeta un recours contre cette décision du Président de la commission de recours . Elle fit valoir, notamment, que son mariage étant postérieur au 1^ 1 janvier 1979, les dispositions de la nouvelle loi lui étaient devenues applicables rétroactivement et étaient dès lors également applicables le 20 avril 1979 . Cependant, à partir du 20 avril 1979, la nouvelle loi ne prévoyait pas le retrait des prestations-invalidité du fait du mariage d'une femme . Par conséquent, la décision prise par l'Association professionnelle le 13 juillet 1979 de lui retirer ses prestations à dater du 20 avril 1979 en raison de son mariage était dépourvue de justification . Le 20 mai 1983, cependant, la commission de recours déclara sans fondement le recours de la requérante : non seulement l'article 32 de la nouvelie loi lui était bien applicable, mais également l'article 6 qui énonce, en matière de revenus salariaux, des conditions que la requérante ne remplit pas . GRIEFS La requérante s'est plainte de ce que l'ancienne loi générale sur l'incapacité de travail (1976), prévoyant que les femmes perdaient leur droit aux prestationsinvalidité après le mariage, était contraire à l'article 12 de la Convention car cela revenait à pénaliser le mariage d'une femme . Dès lors, l'interprétation des dispositions transitoires de la nouvelle loi générale sur l'incapacité de travail méconnaissait ses droits au regard de l'article 12 de la Convention . En outre, la requérante s'est plainte de ce que cette interprétation constituait une différence discriminatoire de traitement entre, notanunent, hommes et femmes mariées, ce qui est contraire aux dispositions de la Convention . Elle a invoqué, à cet égard, l'article 14 de la Convention, lu en liaison avec l'article 1 - du Protocole additionnel et l'article 12 de la Convention .
EN DROIT (Extrait ) ............... 2 . La requérante s'est plainte qu'en lui retirant ses prestations en venu de la loi ancienne et en ne les reprenant pas en venu des dispositions transitoires de la loi nouvelle, elle s'est trouvée pénalisée du fait de son mariage, ce qui est contraire à l'anicle 12 de la Convention, ainsi libellé : . A partir de l'àge nubile, l'homme et la femnte ont le droit de se marier et de fonder une famille selon les lois nationales régissant l'exercice de ce droit . La Commission estime cependant que l'aptitude de la requérante à exercer son droit au mariage n'a absolument pas été génée par le retrait des prestations-invalidité et qu'à cet égard, le grief de la requérante doit dès lors être rejeté, confotmémen t

à l'article 27 par . 2 de la Convention, pour incontpatibilité ratione materiae avec les dispositions de la Convention . 3 . La requérante s'est plainte en outre de ce que, n'ayant plus droit alors aux prestations-invalidité du seul fait qu'elle était une femme qui contractait mariage, elle était devenue victime d'une discrimination contraire à l'article 14 de la Convention, lu en liaison avec l'article 12 et avec l'article I du Protocole additionnel à la Convention . L'article 14 est ainsi libellé : « La jouissance des droits et libertés reconnus dans la présente Convention doit étre assurée, sans distinction aucune, fondée notamment sur le sexe, la race, la couleur, la langue, la religion, les opinions politiques ou toutes autres opinions, l'origine nationale ou sociale, l'appartenance à une minorité nationale, la fortune, la naissance ou toute autre situation . La Commission rappelle que cette disposition n'a pas d'existence indépendante mais n'interdit la discrimination qu'en rapport avec lajouissance des droits et libertés garantis par la Convention . Il est exact que la requérante a invoqué l'article 12 de la Convention et l'article I du Protocole additionnel, lu en liaison avec l'article 14 . Cependant, la Commission l'a constaté plus haut, les griefs tirés par la requérante de l'article 12 échappent au domaine de la Convention et il ne se pose dès lors aucun probléme au regard de cette disposition lue en liaison avec l'article 14 . La Commission a ensuite exaniiné les griefs tirés par la requérante de l'article I du Protocole additionnel . Elle relève que la législation sur la sécurité sociale, à savoir la loi générale sur l'incapacité de travail, est conçue comme une assurance générale (Volksverzekering) fondée sur le principe de la solidarité sociale . Il n'y a pas de lien direct entre le taux des cotisations et les prestations accordées . En conséquence, personne ne jouit jamais d'une pan identifiable et exigible du fonds commun . Dès lors, la Commission estime que, dans ces conditions, le droit aux prestations ne saurait étre considéré comme un droit de propriété pouvant étre qualifié de .bien- au sens de l'article 1 du Protocole additionnel . En conséquence, les griefs tirés par la requérante de l'anicle I de ce Protocole doivent être rejetés conformément à l'article 27 par . 2 de la Convention pour incompatibilité ratione materiae avec les dispositions de la Convention . 11 s'ensuit que les griefs tirés par la requérante de l'article 14 de la Convention . lus en liaison avec l'article 12 de la Convention et avec l'article I du Protocole additionnel doivent eux aussi être rejetés comme incompatibles ratione materiae avec les dispositions de la Convention au sens de l'article 27 par . 2 de la Convention .
