THE FACTS

The applicant is a Dutch citizen, bom on 27 July 1953 in Nijmegen and presently residing in Amsterdam . She is represented by Mr G .P . Hamer, a lawyer practising in Amsterdam . On 4 January 1983 the applicant's brother filed a request with the District Court of Nijmegen lo the effect that the applicant be taken into provisional detention in a psychiatric hospital . As required by Art . 16 of the Mentally lII Persons Act (Krankzinnigenwet), the request was accompanied by a medical declaration . This declaration was drawn up by someone stating to be a doctor but no psychiatrist .

With regard to the question whether it was necessary or desirable that the applicant be treated in a psychiatric hospital, the declaration stated that the applicant could not remain in her present environment as adequate treatment there was not possible . Furthermore, the declaration explained, the applicant refused to be voluntarily admitted to a psychiatric hospital and also refused to receive any psychiatric treatment . According to the declaration, the state of inental illness warranting such treatment was indicated by hallucinations, delusions, extreme self-neglect and a permanent refusal to communicate . Concerning the question whether the applicant's condition rendered it poindes s or medically inadvisable for her to be heard by the court, the declaration set forth that, although the applicant was not aggressive, a conversation with her was impossible and a visit to the District Court could only take place through the use of force . On 5 January 1983, the District Court judge (Kantonrechter) of Nijmegen, having found that the medical declaration submitted sufficiently demonstrated that the applicant was in a state of mental illness and that her treatment in a psychiatric hospital was necessary, and having considered it pointless to hear the applicant, issued an order for the provisional detention of the applicant at the psychiatric hospital of Venray for a period of six months . The applicant, thereupon, was taken to this hospital where she, apparently , regularly had to undergo treatment against her will . However, allegedly after the applicant had run away and had contacted a lawyer in regard to her release from the hospital, the applicant was released on 27 April 1983 upon the revocation of the provisional detention order .
Complaint s The applicant has complained that the doctor who drew up the medical declaration hardly examined her and that the findings in the declaration were to a large extent based on the testimony of members of the applicant's family . The applicant, therefore, claims that it has been insufficiently established that she was of unsound mind and alleges a violation of Art . 5 para I (e) of the Convention . In addition, the applicant has complained that on the basis of the medical declaration the District Court judge should have given her the opportunity to be heard, or to be represented, in order to enable her to oppose the request lodged against her . The applicant also complains that the District Court judge could never have concluded that the applicant was actually a danger to herself or others . In these respects, the applicant invokes Art . 5 para I . Furthermore, the applicant has complained that, since she was never informed of the reasons for her detention, she was prevented from taking proceedings t o

challenge its lawfulness . In relation to this, the .applicant claims that as she wasar against her, she could nott-restdwihouanypvsifcoheprdings seek legal assistance . This was also made impossible during her: detention because of the nature of the psychiatric hospital . The Commission finds that that the applicant has failed to substantiate how the matter in question could fail to respect her private life in a manner incompatible with this provision . It follows that this part of the application must therefore be rejected as manifestly ill-founded within the meaning of Article 27 para 2 of the Convention . 2 . The applicant has also complained that she was detained in a mental institution in an arbitrary manner . In this respect she has invoked Articles 5 para I and 5 para 4 of the Convention . She has funhermore, complained that she was not given a fair hearing as guaranteed by Article 6 para I of the Convention . The respondent Government have not contested the applicant's complaints with regard to the lawfulness of her detention and thus its conformity with the requirements of Art . 5 para I . The Commission considers that these complaints concerning the lawfulness of the applicant's detention and remedies available to her raise complex issues of fact and law which can only be resolved by a full examination on the merits . It follows that this aspect of the applicant's complaints cannot be declared manifestly ill-founded and must be declared admissible, no other ground of inadmissibility having been established . (TRADUCTION) EN FAIT La requérante est citoyenne néerlandaise, née le 27 juillet 1953 à Nimègue, et résidant actuellement à Amsterdam . Elle est représentée par Me G . P . Hamer, avocat à Amsterdam . Le 4 janvier 19 8 3, le frère de la requérante demanda au tribunal du district de Nimègue que sa saur ftlt internée provisoirement dans un hôpital psychiatrique . Comme l'exige l'article 16 de la Loi sur les malades mentaux (Krankzinnigenwet), la demande était accompagnée d'une attestation médicale . Celle-ci avait été établie par une personne qui se disait médecin mais n'était pas psychiatre .

Quant à la question de savoir s'il était nécessaire ou souhaitable que la requérante fût traitée dans un hôpital psychiatrique, l'attestation indiquait qu'elle ne pouvait demeurer dans son milieu ordinaire, un traitement approprié n'y étant pas possible . D'autre part, expliquait l'attestation, la requérante refusait d'entrer volontairement à l'hôpital psychiatrique, comme d'ailleurs de recevoir quelque traitement psychiatrique que ce fût . Encore selon l'attestation, l'état de maladie mentale justifiant un tel traitement se manifestait par des hallucinations, des illusions, une négligence corporelle extrême et un refus permanent de communiquer . Quant à la question de savoir si l'état de la requérante rendait inutile ou médicalement inoppoilun qu'elle fût entendue par le tribunal, l'attestation expliquait que, bien que la requérante ne ftlt pas agressive, une conversation avec elle était impossible et qu'une visite au tribunal de district ne pourrait avoir lieu que par l'emploi de la force . Le 5 janvier 1983, le juge (Kantonrechter) du tribunal du district de Nimègu e ayant estimé que l'attestation médicale démontrait suffisanunent que la requérante était atteinte de maladie mentale et que son traitement en hôpital psychiatrique était nécessaire, et ayant considéré qu'il était inutile de l'entendre, rendit une ordonnance d'intemement provisoire de la requérante à l'hôpital psychiatrique de Venray, pour une période de six mois . La requérante fut alors conduite à cet hôpital où, apparemment, elle dut régulièrement se soumettre à un traitement contre sa volonté . Il appert cependant qu'après s'être évadée et avoir pris contact avec un avocat au sujet de sa libération de cet hôpital, elle a été effectivement libérée le 27 avril 1983 par révocation de l'ordonnance d'intemement provisoire . GRIEFS La requérante se plaint de ce que le médecin qui a rédigé l'attestation l'a à pein e examinée et que les éléments de l'attestation étaient dans une large mesure fondés sur les témoignages de membres de sa famille . Elle prétend donc qu'il a été insuffisamment établi qu'elle aurait été ntalade mentalement, et allègue une violation de l'article _5 par . 1 e) de la Convention . La requéranté soutient en outre qu'iu vu de l'attestation médicale, le juge du tribunal de district aurait dtl lui donner la possibilité d'être entendue ou d'étre représentée, afin de s'opposer à la requête dirigée contre elle . Elle affinne que le juge n'aurait jamais dû conclure qu'elle représentait effectivement un danger pour ellemème et pour les autres . . A ces égards, la requérante invoque l'article 5 par . 1 . Elle se plaint en outre de n'avoirjamais été informée des raisons de sa détention et de n'avoir pu, en conséquence, engager une procédure pour en contester la légalité . - 210 -
A ce sujet, elle déclare qu'ayant été enferrnée sans avoir été avertie de la procédure ouverte contre elle, elle a été dans l'impossibilité de recourir à une assistance juridique . Pareil recours lui fut également impossible au cours de sa détention, en raison du caractére même de l'hôpital psychiatrique . La requérante prétend avoir été ainsi victime d'une violation de l'article 5 par . 4 de la Convention . Elle se plaint encore que, comme elle n'a pas été entendue par un tribunal et n'a pas eu la possibilité de demander une assistance judiciaire, sa cause n'ait pas été entendue équitablement au sens de l'article 6 par . I de la Convention . Sur ce point, elle se plaint également que l'ordonnance d'internement n'ait pas été rendue publiquement . La requérante ajoute enfin que, l'ordonnance d'internement provisoire ayant été adressée à deux destinataires appelés le GG et le GD (service médical local), ainsi qu'à la municipalité de Wijchen, il y a eu violation de l'anicle 8 de la Convention .
PROCÉDURE DEVANT LA COMMISSION Le 7 décembre 1983, la Commission a décidé de porter la requéte à la connaissance du Gouvemement néerlandais et d'inviter celui-ci à présenter par écrit des observations sur la recevabilité et le bien-fondé de la requête . Les observations du Gouvernement ont été reçues le 21 février 1984 . La requérante n'a pas soumis de réponse écrite . OBSERVATIONS DES PARTIES Le Gouvernemen t Dans sa lettre du 15 février 1984, qui contenait é galement ses observations sur la requête No 10535/83, le Gouvemement indiquait ce qui suit à la Commission : « De l'avis du Gouvernement néerlandais, la procédure du tribunal de district qui a amené l'internement provisoire de la requérante dans un hôpital psychiatrique constituait une violation à la fois de l'article 5 de la Convention européenne des Droits de l'Homme, et de l'anicle 17 par . 3 de la Loi néerlandaise sur les malades mentaux (Krankzinnigenwet) .La requérante L'avocat de la requérante a indiqué par téléphone à la Commission, le 28 mars 1984, qu'il n'estimait pas nécessaire de soumettre des observations en réponse . EN DROI T 1 . La requérante se plaint de ce que la transmission de deux exemplaires de l'ordonnance d'intemement provisoire au service médical local et à sa municipalité lésait les droits que lui garantit l'anicle 8 de la Convention . - 211 -
La Commission estime que la requérante n'a pas démontré comment les faits en question manquaient au respect de sa vie privée d'une maniére incompatible avec cette disposition . Il suit que cette partie de la requête doit être rejetée comme manifestement mal fondée, au sens de l'article 27 par . 2 de la Convention . _ 2 . La requérante se plaint également d'avoir été détenue de manière arbitraire dans un établissement psychiatrique . Elle invoque à cet égard l'article 5 par . 1 et 4 de la Convention . Elle se plaint également que sa cause n'a pas été entendue équitablement, comme le veut l'article 6 par . 1 de la Convention . Le Gouvernement défendeur n'a pas contesté les plaintes de la requérantéquant à l'illégalité de son internement et à sa non-conformité aux dispositions de l'ârticle 5 par . t . La Commission estime que ces plaintes, portant sur la légalité de l'internement de la requérante et les recours qui lui étaient ouverts, soulèvent des problèmes complexes en fait et en droit, qui ne peuvent être résolus que par un examen complet du bien-fondé de la requète . B s'ensuit que cet aspect de la requète ne peut être déclaré manifestement mal fondé et doit, en l'absence d'autres motifs d'irrecevabilité, étre déclaré recevable . Par ces motifs, la Commissio n I . DÉCLARE IRRECEVABLES les griefs de la requérante relatifs au respect de sa vie privée . ' DÉCLARE RECEVABLE le reste de la requête, tous moyens de fon d ;2
