THE FACTS
The facts of the case as submitted by the applicant may be summarised as follows : The applicant was, at the time of lodging the application, a Dutch citizen, but, since the independence of Surinam on 25 November 1975 has been a citizen of Surinam . He was born in 1919 and resides in Paramaribo . He is representing the "Union of descendants of immigrants and Indians" and acting under a power of attorney of 26 September 1975 . From his statements and documents submitted, it appears that the Union claims rights of property over Surinam which, in its opinion, was illegally occupied by the Dutch in 1573 . The applicant alleged that since the occupation the Dutch had brought into the country a number of Negroes, Hindus, Jews, Chinese, Japanese, Portuguese and other people not being the original inhabitants of the country . He stated that Surina m

which, under the " Statute of the Kingdom of the Netherlands"' had been autonomous insofar as internal matters were concerned, was only governed by black people and that, as a consequence, at the declaration of independence, the former colony would, in fact, be returned to the black instead of to the original population . The applicant fu rther submi tt ed that the descendants of the Indians feared discrimination and claimed that they should have been represented at the negotiations concerning the independence of the count ry . On . . . June 1975 he submitt ed a request for a garnishee order ( Ko rt geding) on Surinam to the District Judge (Kantonrechter) in Paramaribo, but it was rejected as ill-founded, the applicant not having shown the validity of his claim . On . . . July 1975 the applicant instituted civil proceedings against the Queen and the Prime Minister of the Netherlands before the District Judge, claiming prope rt y rights over Surinam on behalf of the Indians and compensation of 165 million Surinam guilders . The case was apparently due to be heard on . . . December 1975 .
A second request for a garnishee order was rejected on . . . August 1975 on the same grounds as before . On . . . September 1975 the applicant instituted injunction proceedings against the District Judge, again claiming prope rty rights over Surinam, on behalf of the Indians . The claim was, however, rejected on the ground that the applicant was not properly representing the "Union" . On . . . November the applicant's claim was again turned down for not having directed his claim against the State of the Netherlands . On 25 November 1975 the independence of Surinam was proclaimed . By decision of . . January 1976 the District Judge rejected the applicant's claims made on . . . July 1975 as being unmotivated .
Complaint s The applicant now complains that the independence of Surinam should only have been granted to the descendants of the Indians and not to the black population . He further claims property rights over Surinam on behalf of the Indians and compensation for damages, or, in the alternative, an amount of 165 million Surinam guilders if the Indians were to cede the rights on the territory .
THE LA W 1 . It is first to be observed that the Kingdom of the Netherlands by Declaration of 29 November 1955, extended, in accordance with Article 63, the Convention to Surinam and the Netherlands West Indies . By Declaration of 1 January 1974 the declarations made under Articles 25 and 46 were also made applicable to Surinam . However, the Convention ceased to apply to Surinam when it became an independent State on 25 November 1975 . In so far as the applicant's complaints relate to the acts by the judicial authorities subsequent to 25 November 1975, these acts can in no way be held to involve an y 1 . Agreement concluded between the Kingdom in Europe, Surinam and the Dutch West Indies, creatinp a new legal order for the Kingdom of the Netherlands in which the three parts would look independently efter their own interests and on an equal footing after the general interests .

responsibility under the Convention of the Kingdom of the Netherlands . In this respect the Commission refers to its previous decision on the admissibility of Application No . 3813/68 (Collection of Decisions 32, p .9) . Therefore, the Commission has no competence ratione personae to examine these complaints . The Commission wil now come to the complaints concerning events whic h occurred prior to the said date . 2 . The applicant has complained that the independence of Surinam should only have been granted to the descendants of the Indians and not to the black population . However, under Art . 25 (1 ) of the Convention, it is only the alleged violation of one of the rights and freedoms set out in the Convention that can be the subject of an application presented by a person, non-governmental organisation or group of individuals . With regard to the above complaint it is clear that in fact it relates to the right to self-determination . This right is, however, not as such included among the rights and freedoms guaranteed by the Convention . It follows that this part of the application is incompatible ratione materiae with the provisions of the Convention within the meaning of Art . 27 (2) . 3 . The applicant has further claimed the right to property over the territory of Surinam and compensation for what the Indians had suffered during four centuries of Dutch occupation . It is true that Art . 1 of the Protocol secures to everyone the right to the peaceful enjoyment of his possessions and provides that no-one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law .
The Commission notes that the applicant has not submitted the slightest proof of evidence as to the alleged claims . However, even if the applicant could be considered as being able to furnish such proof, the Commission is not required to decide whether or not the factlolleged by the applicant disclose any appearance of a violation of the above provision as, under Art . 26 of the Convention, it is only required to do so if all domestic remedies have been exhausted according to the generally recognised rules of international law . In the present case the applicant failed to appeal from any of the decisions of the . District Judge (prior to 25 November 1975) to the Court of Justice (Hof van Justitie) and has, therefore, not exhausted the remedies available to him under Surinam law . Moreover, an examination of the case as it has been submitted, including an examination made ex officio, does not disclose the existence of any special circumstances which might have absolved the applicant, according to the generally recognised rules of international law, from exhausting the domestic remedies at his disposal . It follows that the applicant has not complied with the condition as to the exhaustion of domestic remedies and his application must in this respect be rejected under Art . 27 (3) of the Convention . For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBLE.

(TRADUCTION ) EN FAI T Les faits de la cause, tels qu'ils ont été présentés à la Commission par le requérant, peuvent se résumer comme suit : Le requérant était de nationalité néerlandaise au moment où il a introduit sa requête mais est devenu citoyen du Surinam depuis l'indépendance de ce pays, le 25 novembre 1975 . II est né en 1919 et réside à Paramaribo . II représente l'rr Union des descendants d'immigrants et l'Indiens» et agit en vertu d'un mandat daté du 26 septembre 1975 . Il ressort des déclarations du requérant et des documents présentés par lui que l'Union revendique des droits de propriété sur le territoire du Surinam qui, à son avis, a été illégalement occupé par les Néerlandais en 1573 . Le requérant a allégué que depuis cette occupation les Néerlandais ont fait entrer dans le pays un certain nombre de Noirs, Indiens, Juifs, Chinois, Japonais, Portugais et autres, qui n étaient pas les habitants primit'rfs du pays . II a ajouté que le Surinam, autonome pour les affaires internes dans le cadre du a Statut du Royaume des Pays-Bas »' n'avait été gouverné que par des Noirs et qu'en conséquence, à la déclaration d'indépendance, l'ancienne colonie reviendrait aux Noirs et non pas à la population primitive . Le requérant fait valoir, en outre, que les descendants des Indiens craignaient la discrimination et estimaient qu'ils auraient d0 étre représentés aux négociations concernant l'indépendance du pays .
Le . . . juin 1975, le requérant a soumis au tribunal cantonal IKantonrechterl de Paramaribo une demande d'ordonnance de mainmise (Kortgeding) sur le territoire du Surinam ; cette demande a été rejetée comme mal fondée, le requérant n'ayant pu établir la validité de ses prétentions . Le . . . juillet 1975, le requérant a engagé une procédure civile contre la Reine et le Premier Ministre des Pays-Bas devant le tribunal cantonal, en revendiquant des droits de propriété sur le territoire du Surinam au nom des Indiens et en demandant 165 millions de florins locaux à titre de réparation . Le procés devait apparemment avoir lieu le . . . décembre 1975 . Une deuxiéme demande d'ordonnance de saisie a été rejetée le . . . août 1975 pour les mêmes motifs que la premiére . Le . . . septembre 1975, le requérant revendiquant à nouveau des droits de propriété sur le territoire du Surinam au nom des Indiens, a engagé devant le tribunal cantonal une procédure tendant à une ordonnance exécutoire (injunction) . Toutefois, la demande a été rejetée pour le motif suivant : le requérant ne représentait pas valablement l'e Union » . Le . . . novembre, la demande du requérant a été repoussée à nouveau, pour n'avoir pas intenté action contre l'Etat néerlandais .
Le 25 novembre 1975, l'indépendance du Surinam a été proclamée . Par décision du . . . janvier 1976, le tribunal cantonal a estimé que les demandes présentées par le requérant le . . . juillet 1975 n'étaient pas motivées et les a rejetées . ' Accord conclu entre le Royaume en Europe . Surinam et les Indes occidentales néerlandaises et établie5ant pour le Royaume des Pays-Bas un nouvel ordre juridique dans lequel les trois parties veilleraient indépendamment à leurs intérSts propres et sur un pied d'épaliré aux intérbts pénéraux .

Argumentation du requérant Le requérant fait valoir que l'indépendance du Surinam n'aurait d0 étre accordée qu'aux descendants des Indiens et non à la population noire ; Il revendique en outre des droits de propriété sur le territoire du pays, au nom des Indiens, et la réparation des dommages subis, ou une somme de 165 millions de florins du Surinam si les Indiens devaient céder leurs droits sur le territoire .
EN DROIT 1 . II y a lieu de remarquer tout d'abord que le Royaume des Pays-Bas, par déclaration du 29 novembre 1955, conformément à l'article 63, a étendu la Convention au Surinam et aux Indes occidentales néerlandaises . Par déclaration du 1•' janvier 1974, les déclarations faites en vertu des articles 25 et 46 ont également été rendues applicables au Surinam . Toutefois, la Convention a cessé de s'appliquer au Surinam lorsque le pays est devenu un Etat indépendant, le 25 novembre 1975 . Dans la mesure où les griefs du requérant ont trait à des actes des autorités judiciaires postérieurs au 25 novembre 1975, le Royaume des Pays-Bas ne peut en aucune maniére être tenu pour responsable de ces actes aux tennes de la Convention . A cet égard, la Commission se réfère à sa décision antérieure sur la recevabilité de la requête N° 3813/68 (Recueil de décisions 32, p . 9) . La Commission n'est donc pas compétente retione personae pour examiner ces griefs . La Commission en vient ensuite aux demandes concernant des événements qui se sont produits avant la date précitée. 2 . Le requérant a fait valoir que l'indépendance du Surinam aurait dû être accordée aux descendants des Indiens et non à la population noire . Toutefois, selon l'article 25 (1) de la Convention, seule une prétendue violation de l'un des droits ou de l'une des libertés reconnus dans la Convention peut faire l'objet d'une requôte présentée par une personne physique, une organisation non gouvernementale ou un groupe de particuliers . Or, il est évident que la demande ci-dessus concerne le droit à l'autodétermination . Ce droit ne figure pas, en tant que tel, parmi les droits et libertés que garantit la Convention . II en résulte que cette partie de la requête est incompatible ratione materiae avec les dispositions de la Convention au sens de l'article 27 (2) . 3 . Par ailleurs, le requérant a revendiqué un droit de propriété sur le territoire du Surinam et une indemnisation à raison de ce qu'ont enduré les Indiens pendant quatre siécles d'occupation néerlandaise . L'article 1 du Protocole stipule effectivement que toute personne a droit au respect de ses biens et que nul ne peut être privé de sa propriété, si ce n'est pour cause d'utilité publique et dans les conditions prévues par ta loi et les principes généraux du droit international . La Commission observe que le requérant n'a pas présenté le moindre élément de preuve à l'appui de ses revendications . En outre, à supposer même qu'il puisse 8tre jugé capable de fournir de telles preuves, la Commission ne serait pas appelée à déterminer si les faits allégués permettent de conclure à une violation de la disposition ci-dessus . En effet, la Commission ne peut être saisie, aux termes de l'article 26 de la Convention, qu'aprés l'épuisement des voies de recours internes tel qu'il est entendu selon les principes de droit international généralement reconnus .

Dans la présente affaire, le requérant n'a recouru devant la cour de justice (Hof van Justitie) contre aucune des décisions du tribunal cantonal (rendues avant le 25 novembre 1975) et n'a donc pas épuisé les recours dont il disposait en droit du Surinam . En outre, l'examen de l'affaire telle qu'elle a été présentée, y compris un examen ex officio, ne révéle pas de circonstances particulières qui auraient pu dispenser le requérant, selon les principes de droit international généralement reconnus, d'épuiser les recours internes dont il disposait . Il ressort de ces observations que le requérant n'a pas respecté la condition de l'épuisement des recours internes et que sa requête doit é cet égard être rejetée en vertu de l'article 27 (3) de la Convention . Par ces motifs, la Commission DECLARE LA REQUETEIRRECEVABLE .
