Les faits de la cause, tels qu'ils ont été exposés par les requérants, peuvent se résumer comme suit : R . F . et son épouse S . F ., nés en 1953 et en 1955 respectivement, sont de nationalité autrichienne et habitent à H . lls sont représentés par Me G . Hagen, avocat à Dornbirn . Le 22juin 1983, la direction supérieure de la police pour le Land du Vorarlberg (Sicherheitsdirektion) a publié sous le numéro 156 un communiqué de presse libellé comme suit : -die krint .abt . des lgk f vlbg beobachtete seit einiger zeil den 30 j alten R . P . aus hohenenis . fernfahrer, und dessen ehefrau S . wegen verdacht des suchtgifthandels . am 20 .6. 1983, um ca 17 .20 uhr, konnten beamte der krim .abt . S . F . dabei ueberraschen, wie sic am bahnhof in hohenems I kg haschisch in plattenform an zwei maenner aus bregenz und zwar an den 24 j alten manfre,d b . . ohne beschaeftigung . und den 26 j alten roland s ., ebenfalls ohne beschaeftigung, uebergeben wollte . alle 3 personen wurden festgenommen und in das Landesgef .haus feldkirch eingeliefert . bei einer hausdurchsuchung konnten im haus der S . F . weitere 300 g haschisch (cannabisharz) einige trips Isd, haschischpfeife und verschiedene waffen sichergestelll werden . bei den sichergestellten waffen handelt es sich zunt grossteil um erlaubte waffen . fuer eine sichergest . pistole ist eine waffenrechtliche urkunde vorhanden . der ehemann der dealerin, R . F ., war zur zeit der tat mit einem Ikw im ausland unterwegs und stellte sich am 22 .6 .1983 bei der krim .abt . in bregenz . nach dem bisherigen stand der ermittlungen handelt es sich bei allen vier festgenommenen sowohl um konsumenten als auch um haendler . einen teil des eingekauflen haschisch soliten die zwei maenner aus bregenz angeblich an eine tiroler haendlergruppe weiterverkaufen . die sich zur selben zeit ebenfalls in hohenems aufgehalten haben soll . entsprechende ermittlungen dazu sind dzt . im gange . wert des haschisch : ca s 130 .000 . (Traductio N - La police de Vorarlberg surveillait depuis quelque temps R .F . de H ., 30 ans . conducteur de poids lourd, et son épouse S ., soupçonnés de trafic de drogues . Le 20 .6 .1983 . à environ 1 7 H 20, des agents de police ont pu surprendre S . F . au ntoment où elle voulait remettre, à la gare de Hohenems . I kilo de haschisch en plaques à deux hommes de Bregenz, à savoir Manfred B . . 24 ans, sans emploi, et Roland S ., 26 ans, égalenient sans emploi . Les trois personnes ont été arrétées et incarcérées à Feldkirch . Lors d'une perquisition au domicile de S . F . 300 g de haschisch, quelques doses de Lsd, une pipe à haschisch et diverses armes ont pu étre saisis . En ce qui concerne les armes saisies il s'agit en grande partie d'armes dont la détention est autorisée . Pour un pistolet sais i

il existe un permis de port d'arme . Le mari de la trafiquante, R . F . était au moment des faits, en déplacement à l'étranger sur un poids lourd et il s'est présenté le 22 .6 .1983 à la police de Bregenz . Dans l'état actuel de l'enquéte il s'agit, pour les quatre personnes arrétées, tant de consommateurs que de trafiquants . Les deux hommes de Bregenz prétendent avoir eu l'intention de revendre une panie du haschisch acheté à un groupe de trafiquants tyroliens, qui se seraient également trouvés à cette époque à Hohenems . L'enquète est à ce sujet actuellement en cours . Valeur du haschisch ~ environ 130 .000 Sch . •
Le communiqué de presse a été exploité les 23 et 24juin 1983 par lesjournaux suivants : - Vorarlberger Nachrichten- . •Neue VorarlbergerTageszeitung•, •Kronenzeitung . et •Kurier• . A l'exception de la •Kronenzeitung• les journaux ont publié avec les articles une photo montrant les objets saisis . La photo a été, semble-til, prise par la police et mise à la disposition de la presse . La diffusion par la police du communiqué de presse du 22 juin 1983 ne pouvait étre attaquée par un recours . En particulier, les requérants ne pouvaient pas saisir la Cour constitutionnelle qui, dans une affaire analogue, s'était déclarée incompétente (cf . N" 9077/80, déc . 6 .10 .81 . D .R . 26 p . 21I) . En effet, dans cette affairela Cour a rejeté le recours formé contre la diffusion d'un communiqué de presse par la police, au ntotif que le communiqué litigieux ne constituait ni une décision administrative (Bescheid) ni l'exercice d'un pouvoir administratif direct de commandement et de contrainte (Ausübung unmittelbarer verwaltungsbehtirdlicher Befehlsund Zwangsgewalt) . la Cour ne s'estimait donc pas compétente pour examiner l'acte administratif litigieux sous l'angle de la Constitution (cf . article 144) .
GRIEFS Les griefs des requérants peuvent se résumer comme suit : I . Les requérants se plaignent d'une violation de la présomption d'innocence du fait que la police a publié une phoiographie montrant les objets saisis lors d'une enquête de la police- à savoir de la drogue pour le trafic de laquelle ils ont été accusés ultérieurement et des armes, dont une détenue légalement, qui n'ont pas fait l'objet d'accusations . La juxtaposition des deux catégories d'objets, drogue et armes, les faisaient passer aux yeux du public pour des trafiquants dangereux . Ils auraient de ce fait subi des vexations de la part de leur entourage . En outre, le communiqué de presse publié par la police n'était pas suffisamment précis en déclarant • En ce qui concerne les armes saisies il s'agit en grânde panie d'armes dont la détention est autorisée• . Les requérants invoquent l'article 6 par . 2 de la Convention .

EN DROIT (Extrait ) I . Les requérants se plaignent de la publication d'une photographie montrant les objets saisis lors d'une enquète de la police, à savoir de la drogue pour le trafic de laquelle ils furent inculpés ultérieurement et des armes, dont une détenue légalement, qui n'ont pas fait l'objet d'inculpations . La juxtaposition de ces deux catégories d'objets les aurait fait passer pour des trafiquants dangereux . De l'avis des requérants . le contniuniqué de presse n'élait pas suffisamment précis en déclarant qu'• en ce qui concerne les armes saisis il s'agit en grande partie d'armes dont la détention est autorisée • . Les requérants invoquent l'article 6 par . 2 de la Convention, qui dispose : •Toute personne accusée d'une infraction est présumée innocente jusqu'à ce que sa culpabilité ait été légalement établie . • La Commission admet que, sur ce point, les requérants ont épuisé les voies de recours internes (cf. 9077/80, déc . 6 .10 .81, D .R . 26 p . 211) . L'anicle 6 par . 2 consacrant le principe de la présomption d'innocence, est avant tout une garantie de caractère procédural qui s'applique à toute procédure pénale (ef . N" 788/60, Autriche c/Italie, Annuaire 6 p . 785) . Toutefois, dans sa décision sur la recevabilité de la requéte N" 7986/77, Petra Krause c/Suisse (déc . 3 .10 .78 . D .R . 13 p . 73), la Commission a estimé que le principe de la présomption d'innoeence ne se limite pas à une garantie pracédurale- mais qu'il exige qu'aucun représentant de l'Etat ne déclare qu'une personne est coupable d'une infraction avant que la culpabilité ait été établie par un tribunal .
La Coinmission s'est exprimée conime suit : • Le principe fondamental que consacre cet article garantit à tout individu que les représentants de l'Etat ne pourront pas le traiter comme coupable d'une infraction avant qu'un tribunal compétent ne l'ait établi selon la loi . Il peut donc y avoir violation de l'a rt icle 6 par . 2 lorsque des magistrats déclarent qu'une personne est coupable d'une infraction sans qu'un tribunal n'en ait ainsi décidé . Il ne s'ensuit évidemment pas que les autorités doivent s'abstenir d'informer le public des enquètes pénales en cours . Elles ne méconnaissent pas l'a rt icle 6 par . 2 . en déclarant qu'il existe des soupçons, que cenaines personnes ont été arrètées, qu'elles ont fait des aveux, etc . Ce qui, par contre, doit étre exclu, c'est une déclaration fornielle qu'une personne est coupable (D .R . 13 p . 79) . La Commission considère qu'il y a lieu de tenir compte des circonstances spécifiques de l'affaire et de peser les intéréts en présence, à savoir l'intérêt légitime du public et de la presse à@tre informés, d'une part, et l'intérêt de la personne soupçonnée d'une infraction à la sauvegarde de la présomption d'innocence, d'autre part . En l'espèce, la Commission n'estinte pas injustifiée la diffusion par la police d'un communiqué de presse aprés la découvene d'un trafic d'une grande quantité de drogue . 241
La question de savoir si la diffusion du communiqué et de la photographie était contraire à la garantie de la présomption d'innocence dépend du contenu des documents litigieux (cf. déc . N° 9077/80 susmentionnée) . La Commission considère que, pris dans son ensemble, le texte du communiqué litigieux, tout en relatant les faits reprochés aux requérants, ne reflète pas le sentiment qu'ils sont coupables . En paniculier, la Commission n'aperçoit pas en quoi le passage dont les requérants soulignent l'imprécision serait une affirmation de culpabilité contraire à la garantie de la présomption d'innocence . Enfin, la Commission estime que les requérants n'ont pas montré en quoi la diffusion de la photographie litigieuse pouvait porter atteinte à cette garantie . A supposer méme qu'elle ait pu faire naître une équivoque quant à la nature ou la gravité des infractions dont les requérams étaient soupçonnés . cette photographie ne suggérait pas qu'ils étaient coupables .
L'examen de ce grief ne permet donc de déceler aucune apparence de violation de l'articlc 6 par . 2 de la Convention . Il s'ensuit que cene partie de la requéte est manifestement mal fondée, au sens de l'article 27 par . 2 de la Convention .
(TRANSL4 TION) THE FACTS (Extracts) The facts of the case as stated by the applicants may be summarised as follows : R .E . and his wife S .E ., born in 1953 and 1955 respectively, are Austrian nationals and live in H . They are represented by Mr . G . Hagen . a lawyer practising in Dornbirn . On 22 June 1983 police headquaners of the Land Vorarlberg (Sicherheitsdirektion) published press release No . 156, which reads as follows : "die krim .abt . des lgk f vlbg beobachtete seit einiger zeit den 30j alten R . F . aus hohenents, fernfahrer, und dessen ehefrau S . wegen verdacht des suchtgifthandels . am 20 .6 .1983, um ca 17 .20 uhr, konnten beamte der krim .abt . (Translation ) "The Vorarlberg police has for some time been watching R .F . from H ., aged 30 . a lorry driver and his wife S . under suspicion of drug trafficking . On 20 .6 .1983 at about 5 .30 pm the police officers were able to surprise S .F . when she was about to hand over I kilo of hashish in plates to two men at Hohemens station, namely Manfred B . (24, unemployed) and Roland S . (26, also unemployed) . All three were arrested and detained in Feldkirch prison . On a search al S .F .'s home, 300 g hashish, a few doses of LSD, a hashish pipe and various weapons were seized . The possession of most of the arms seized was lawful and there is a licence for a pistol which was seized . At the time of these events, the husband of the dealer . R .F . . was abroad in his lorry and reported to the police in Bregenz on 22 .6 .1983 . At the present stage of the investigation it appears that the four persons arrested are both consumers and traffickers . The two men from Bregenz that they intended to resell part of the hashish they bought to a group of Tyrol traffickers who were also in Hohemens at the time . Investigations on this subject are still in progress . Value of hashish : about 130 .000 Schillings . " The following newspapers made use of this communiqué on 23 and 24 June 1983 : "Vorarlberger Nachrichten", "Neue Vorarlberger Tageszeitung", "Kronenzeitung" and "Kurier" . Except in the case of the Kronenzeitung . the newspapers published with their articles a photo showing the objects seized . It seems that the photo was taken by the police and made available to the press . There was no rentedy available against the publication of the police press release of 22 June 1983 . In particular the applicants could not bring the matuer before the Consiilutional Court which in a similar case had stated that it had no jurisdiction (ef. No . 9077/80, Dec . 6 . 10 .81, D .R . 26 p . 211) . In that case, the court dismissed the appeal against the publication of a police press release on the grounds that it wa s

neither an administrative decision (Bescheid) nor the exercise of a direct administrative power of command or constraint (Ausübung unmittelbarer verwaltungsbehiirdlicher Befehls- und Zwangsgewalt) . The court therefore held that the constitution gave it no power to examine the administrative act complained of (cf . Article 144) .
COMPLAINT S The applicants' complaints may be summarised as follows : The applicants complain of a violation of the presumption of innocence because 1. the police published a photograph showing the objects seized during a police investigation . namely drugs for the traffic of which they were later accused and weapons, one of which was legally held and in relation to which no charges were brought . The fact that the two categories of objects, drugs and weapons, were shown together, made the applicants appear in the eyes of the public as dangerous traffickers . This led to their being subjected to vexation by those with whom they came in contact . Fu rt hermore, the police press release was not sufficiently accurate in stating " possession of most of the weapons seized was lawful" . The applicants rely on Article 6 para . 2 of the Convention .
THE LAW (Extract ) 1. The applicants complain of the publication of a photograph showing objects seized during a police investigation, namely drugs for the trafficking of which they were later charged and weapons, one of which was legally held, and for which no charges were brought . The fact that these two categories of objects were shown together allegedly made it appear that they were dangerous traffickers . In their opinion the press release was not sufficiently accurate when it stated that possession of "most of the arms seized was lawful" . The applicants rely on Article 6 para . 2 of the Convention which reads : "Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law . " The Commission agrees that on this point the applicants have exhausted the doniestic remedies (cf . No . 9077/80, Dec . 6 . 1 0 .81, D .R . 26 p . 211) . Anicle 6 para . 2 . which lays down the presumption of innocence, is principally a procedural guarantee which applies to all criminal proceedings (cf . No . 788/60 . Austria v . Italy . Yearbook 6 p . 785) . However, in its decision on the admissibility of application No . 7986/77 . Petra Krause v . Swi(zerland . Dec . 3 .10 .78 . D .R . 13 p . 73) . the Commission held that the presumption of innocence is not limited to a

procedural guarantee but requires that no representative of the State shall declare a person guilty of an offence before his guilt is established by a court . The Commission expressed the following opinion : -'1t is a fundamental principle embodied in this Article which protects everybody against being treated by public officials as being guilty of an offence before this is established according to law by a competent coun . Article 6 para . 2, thercfore, may be violated by public officials if they declare that somebody is responsible for criminal acts without a court having found so . This does not niean, of course, that the authorities may not inform the public about criminal investigations . They do not violate Article 6 para . 2 if they state that a suspicion cxists, that people have been arrested, that they have confessed, etc . . . What is excluded, however, is a formal declaration that somebody is guilty (D .R . 13 p . 75 ) . " The Commission considcrs that account must bc taken of the sp~ciGc circuntstances of the case and a balance struck between the interests involved, namely the legitintate interests of the public and the press to be informed and the interest of the person suspected of an offence to the protection of the presumption of innocence . In the instant case, the Commission does not consider that the publication of a press release by the police after the discovery of a traffic involving a large quantity of drugs was unjustif'ted . The question whether the publication of the press release and photograph were contrary io the presumption of innocence depends on the content of the documents in question (cl . the decision in application No . 9077/80 mentioned above) . Taken as a whole, the text of the press release complained of, while stating the facts with which the applicants were charged, did not convey the impression that they were guilty . In panicular, the Commission does not see how the passage, the vagueness of which is stressed by the applicants, amounts to an affirmation of guih contrary to the presuntption of innocence . Finally, the applicants have not shown how the publication ol'the photograph contplained of could amount to an infringement of this guarantee . Even assuming that it could have produced a misunderstanding as to ihe nature and seriousness of the offences of which the applicants were suspected, the photograph did not imply that they were guilty . An examination of this complaint does not, therefore, reveal any appearance of a violation of Article 6 para . 2 of the Convention . It follows that this part of the application is manifestly ill-founded within the meaning of Article 27 para . 2 of the Convention .
