Article 7, paragraph I of the Convention : Conviction for a criminal ofjence under a provision which, although not very clear taken alone, when read in conjunction with another provision of the same statute, is sufficiently precise for individuals to be able to regulate their conduct : not contrary to the Anicle . Article 26 of the Convention : Where an applicant lodges a second appeal with the same court as previously with no new legal arguments, requesting review of the first decision, does a fresh six months' period run from the date of the second judgment ? (Question not pursued) .
Article 7, paragraphe l, de la Convendon : N'est pas contraire à cet article une condamnation prononcée en venu d'une disposition pénale qui, bien que peu explicite si elle est prise isolément, esr néanmoins suffisamment précise lorsqu'elle est lue en liaison avec une autre disposition de la même loi pour permettre aus intéressés de régler leur conduite . THE FACTS
The facts of the case as they appear from the applicant's submissions may be summarised as follows : The applicant, a Liechtenstein citizen born in 1945, is a trustee (Treuhtinder) resident in T ./Liechtenstein dealing, inter alia, with transactions conceming real property . Before the Commission he is represented by Dr . L . Martschitz, a lawyer practising in Dornbirn in Austria . In 1980, E .M ., a Swiss citizen, entered a contract for a five year lease with the applicant's tmstee company (Treuhand AG) in respect of an apartment in Vaduz . The apartment which E .M . rented was in a building owned in 1980 by A .O .AG, a building company of which the applicant was the authorised agent . In 1981, A .O .AG sold this building to the applicant . In 1981, E .M . lent A .O .AG the sums of 240,000 and 130,000 Swiss Francs, repayable in 1990 and 1 991, respectively . As security for these loans, A .O .AG mortgaged the aforementioned building for the same amount to E .M . In 1981, the Liechtenstein Public Prosecutor brought charges against the applicant and E .M . on the basis of S .1(2)(d) and 27(l) of the Liechtenstein Act on Transactions conceming Real Property (Grundverkehrsgesetz) . S .1(2)(d) reads : I . The acquisition of real propeny in the Principality of Liechtenstein requires the permission of the competent autho ri ties for transactions concerning real propeny . 2 . The acquisition of the following shall be treated on an equal footing as the acquisition of real property : . . . . . . . . . . (d) other rights arising in particular from trustee transactions, lease or farm lease contracts of long duration, and credit transactions, insofar as, regardless of the manner and form of the stipulation, the content or extent of these rights enable the pursuance of similar economic purposes as the acquisition of real property or of rights regarding real estate within the meaning of lit . (a) to (c) . "
S . 27 (1) reads : "Whosoever intentionally concludes a legal transaction requiring official permission (S . 1) without having received a legally valid permission for the acquisition, or whosoever circumvents the obligation to obtain such permission in another manner (oder die Genehmigungspflicht sonstwie umgeht) . will be punished by the Court of First Instance on account of a misdemeanour (Uebertretung) with detention of up to three months or with a fine of up to 50,000 SF . In severe cases, both punishments may be combined . . ." .

The Public Prosecutor alleged that, from an economic point of view, the combined effect of the various transactions was such that E .M . had acquired title to the apartment according to S .I(2)(d) of the Act . However, as a foreigner, E .M . would only be permitted to acquire real property in Liechtenstein after ten years' residence in the country, i .e . in 1990 . By nevertheless concluding these transactions, the applicant and E .M . had intentionally circumvented the obligation to obtain pertnission according to S .27(I) . On 26 November 1981, the Liechtenstein Court of First Instance (Landgericht) acquitted the applicant and E .M . of these charges . The Public Prosecutor appealed against the acquittal to the Court of Appeal (Obergericht) which on 19 May 1982 quashed the decision . The court found that the applicant's contracts had been concluded in circumvention of the obligation to obtain permission for such transactions and sentenced the applicant on the basis of S .27(1) of the Act to a conditional sentence of 15 days' detention and a fine of 10,000 SF . E .M . was sentenced to a fine of 5 .000 SF . Upon appeal (Revision), the Supreme Court (Oberster Gerichtshof) upheld the conviction but reduced the sentence to the fine of 10,000 SF only . The applicant then appealed to the High Court of State (Staatsgerichtshof) claiming, inter alia, a violation of Article 7 para . I of the Convention . He also contested the constitutionality of S .27(I) (first sentence, circumvention case) of the Act . On 9 Febmary 1983, the High Court of State found that the applicant's constitutional rights had not been violated . The applicant lodged a further appeal (Vorstellung) with the High Court of State in which he submitted that the latter had not sufficiently considered the arguments of his previous appeal to the same court . He again alleged a violation of Article 7 para . I of the Convention . On 15 September 1983, the High Court of State, which was composed of the same judges as on 9 February 1983- rejected this appeal . The coun found that the appeal did not raise any new legal issues which had not already been dealt with in its judgment of 9 February 1983 ("Die Vorstellung bring( keine neuen rechtlichen Aspekte, die . . . im Urteil vom 9 . Febmar 1983 nicht schon berücksichtigt wdren" . )
COMPLAINT S The applicant complains that the phrase "or whosoever circumvents the obligation to obtain such permission in another manner" in S .27( I) of the Act on Transactions concerning Real Propeny is meaningless . It is impossible to know on the basis of S .27(I) in advance whether or not a transaction will constitute a punishable act . The transactions into which he had entered had each complied with the law and ha d

not required permission . By nevertheless convicting him of a misdemeanour under S .27(I), the Liechtenstein courts had interpreted this provision extensively and per analogiam to his disadvantage . The applicant relies on Article 7 para . I of the Convention .
THE LA W The applicant has complained that S .27(I) of the Liechtenstein Act on Transactions concerning Real Property was not sufficiently clear and did not enable a distinction to be made in advance between permissible and prohibited behaviour . His conviction by the Liechtenstein courts was therefore without legal foundation . He relies on Article 7 para . I . In the present case, the applicant lodged a second appeal (Vorstellung) with the High Court of State in which he invoked the same rights as in his first appeal, inter alia Article 7 para . I of the Convention . The Commission notes that the ensuing judgment of the High Court of State which was composed of the same five judges who passed judgment on 9 February 1983, found that the second appeal did not raise any new legal issues which had not already been dealt with in its previous judgment . An issue arises therefore as to whether or not this second appeal constituted an effective remedy and, consequently, whether the applicant has complied with Article 26 of the Convention according to which the Commission "may only deal with the matter . . . within a period of six months from the date on which the final decision was taken" . The Commission nevertheless leaves this question open since the application is in any event manifestly ill-founded for the following reasons . According to Article 7 para . I of the Convention . "No one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national or international law at the time when it was committed . Nor shall a heavier penalty be imposed than the one that was applicable at the time the criminal offence was committed . " The applicant was convicted and sentenced for an act which was considered by the national courts to fall under the definition of the offence in S .27 of the Act on Transactions conceming Real Property . It is true that S .27( I) makes it a criminal offence to "circumvent" the obligation to obtain permission for certain transactions and that this may not seem to be a very precise definition of the offence . However . S .27 (1) has to be read in connection with S .1(2)(d) of the same Act, and the Commission considers that in this light the provision was nevertheless worded in sufficiently clear terms to enable the persons to whom it was addressed to distinguish between permissible and prohibited behaviour . Legislation concerning the various types of the acquisition of real property can be based on the assumption that the persons concemed have some specialised knowledge of these transactions .

In the instant case the applicant, a trustee who had specialised in real property transactions, was in a position to assess whether the transactions in question pursued "similar economic purposes as the acquisition of real property" under S .1(2)(d) of the Act . There is therefore no element of unreasonable uncertainty in the law amounting to a breach of Article 7 para . I (see Application N° 8141/78, Dec . 4 .12 .78, D . R . 16 p .141) . It follows that there is no appearance of a violation of Article 7 para . I and that this complaint is manifestly ill-founded within the meaning of Article 27 para . 2 of the Convention . For these reasons, the Commissio n DECLARES THE APPLICATION INADMISSIBLE .

EN FAIT Les faits de la cause- tels qu'ils resso rtent des exposés du requérant, peuvent se résumer comme suit : Le requérant, ressort issant du Liechtenstein né en 1945 et domicilié à T . (Liechtenstein), dirige une société financière s'occupant notamment de transactions immobiliéres . Devant la Commission, il est représenté par Me L . Martschitz, avocat à Dornbim, Autriche . En 1980, E .M ., citoyen suisse, signa avec la société du requérant (T . . . AG) un bail de cinq ans concernant la location d'un appariement à Vaduz . L'appartement loué par E .M . était situé dans un bâtiment que possédait en 1980 A .O .AG, société de construction dont le requérant é tait le fondé de pouvoir . En 1981, A .O .AG vendit cet immeuble au requérant . En 1981, E .M . prêta à A .O .AG les sommes de 240 .000 et 130 .000 francs suisses, remboursables respectivement en 1990 et 1991 . En gage de ce prêts, A .O .AG hypothéqua l'immeuble susmentionné pour le même montant au profit de E .M .

En 1981, le parquet du Liechtenstein inculpa le requérant et E .M . de violation des article I par . 2 d) et 27 par . 1 de la loi sur les transactions immobilières au Liechtenstein (GrUndverkehrsgesetz) . L'article 1 par . 2 d) est ainsi libellé : . 1 . L'acquisition de biens immobiliers dans la P ri ncipauté de Liechtenstein est soumise à l'autorisation des autorités compétentes en matière de transactions immobilières . 2 . L'acquisition des intérèts ci-après désignés fait l'objet du même traitement que l'acquisition de biens immobiliers .
(d) d'autres droits nés notamment de transactions fiduciaires, des contrats de bail ou de bail à fertne de longue durée et des transactions de crédit, dans la mesure où indépendamment du mode et de la forme de la stipulation, la teneur ou la ponée de ces droits autorise à poursuivre des objectifs économiques analogues à ceux de l'acquisition de propriétés immobilières ou de droits afférant à la propriété immobiliére au sens des alinéas (a) à (c) . » L'article 27 par . 1 est ainsi libellé : « Quiconque conclut sciemment une transaction juridique soumise à autorisation officielle (article I) sans avoir reçu une autorisation valable pour cette acquisition, ou élude d'une manière l'obligation d'obtenir cette autorisation (oder die Genehmigungspflicht sonstwie umgeht) est passible pour cette contravention (Übertretung) d'une peine maximum de trois mois d'emprisonnement ou de 50 .000 francs suisses d'amende prononcée par le tribunal de première instance . Dans les cas graves, les deux peines peuvent étre cumulées . . . . Le parquet alléguait que, d'un point de vue économique, l'effet combiné des diverses transactions aboutissait à l'acquisition par E .M . d'un droit sur l'appartement conformément à l'article I par . 2 (d) de la loi . En tant qu'étranger cependant, E .M . ne devait être autorisé à acquérir des biens immobiliers au Liechtenstein qu'après dix ans de séjour dans le pays, c'est-à-dire en 1990 . En effectuant néanmoins ces transactions, le requérant et E .M . avaient délibérément éludé l'obligation d'obtenir l'autorisation prévue à l'article 27 par . 1 . Le 26 novembre 1981, le tribunal de première instance (Landgericht) du Liechtenstein prononça l'acquittement du requérant et de E .M . sur ces chefs . Le parquet fit appel de la décision d'acquittement devant la cour d'appel (Obergericht), qui réforma le jugement le 19 mai 1982 . La cour estima que la conclusion des contrats par le requérant avait éludé l'obligation d'obtenir l'autorisation pour effectuer de telles transactions . Se fondant sur l'anicle 27 par. I de la loi, elle condamna le requérant à quinze jours d'emprisonnement avec sursis et à une amende de 10 .000 francs suisses . E .M . se vit infliger une amende de 5 .000 francs suisses . - 239 -
Saisie d'un pourvoi (Revision), la Cour suprême (Oberster Gerichtshof) confirma cette décision mais réduisit la peine à la seule amende de 10 .000 francs suisses . Le requérant se pourvut alors devant la Cour suprême de l'Etat (StaatsgerichtshoF) en alléguant notamment une violation de l'article 7 par . I de la Convention . Il contestait également la constitutionnalité de l'article 27 par . 1(première phrase : fait d'éluder l'obligation) de la loi . Le 9 février 1983, la Cour suprême de l'Etat conclut à une absence de violation des droits constitutionnels du requérant . Le requérant forma un autre recours (Vorstellung) auprés de la Cour suprême de l'Elat, faisant valoir que cette juridiction n'avait pas suffisamment examiné les moyens de son précédent recours . Il alléguait à nouveau une violation de l'article 7 par . I de la Convention . Le 15 septembre 1983, la Cour suprême de l'Etat, dans la même composition que le 9 février 1983, rejeta ce recours . Elle estima qu'il ne posait aucun point de droit nouveau qu'elle n'ait déjà examiné dans son arrèt du 9 février 1983 (•Die Vorstellung bringt keine neuen rechtlichen Aspekte, die . . . im Urteil vom 9 . Februar 1983 nicht schon berücksichtigt wàren» .) .
GRIEFS Le requérant se plaint que le membre de phrase "ou quiconque élude d'une autre manière l'obligation d'obtenir cette autorisation- ftgurant à l'article 27 par . I de la loi sur les transactions immobiliéres est dépourvu de signification . Il est impossible en effet de savoir à l'avance, sur la base de l'article 27 par . 1, si une transaction constituera ou non un acte punissable . Les transactions qu'il a passées étaient toutes conformes à la loi et n'exigeaient pas d'autorisation . En le reconnaissant néanmoins coupable d'une contravention au sens de l'article 27 par. 1 . les tribunaux du Liechtenstein ont interprété cette disposition de maniére extensive et par analogie, à son détriment . Le requérant invoque à cet égard l'article 7 par . I de la Convention .
EN DROI T Le requérant se plaint que l'article 27 par . I de la loi du Liechtenstein sur les transactions immobiliéres ne serait pas assez explicite et ne permeurait pas de distinguer par avance entre un comportement autorisé et un comportement prohibé . Sa condamnation par les tribunaux du Liechtenstein serait dès lors dépourvue de base juridique . Il invoque à cet égard l'article 7 par . I . En l'occurrence, le requérant a introduit auprès de la Cour suprême de l'Etat un second pourvoi (Vorstellung) par lequel il invoque les mêmes droits que lors de son premier recours, notamment l'article 7 par . I de la Convention . La Commission relève que, selon l'arrèt prononcé par la Cour suprême de l'Etat, composée des mêmes cinq magistrats que ceux qui avaient statué le 9 février 1983, le second pourvoi ne posait aucun point de droit nouveau sur lequel elle ne se soit déjà prononcée dans son précédent arrèt .

La question se pose donc de savoir si ce second pourvoi constituait ou non un recours effectif et, partant, si le requérant a satisfait à l'article 26 de la Convention selon lequel la Commission . ne peut étre saisie que . . . dans le délai de six mois à partir de la date de la décision interne définitive . . La Commission ne se prononcera cependant pas sur ce point car la requête est, quoi qu'il en soit, manifestement mal fondée pour les raisons ci-aprés . Aux termes de l'article 7 par . I de la Convention, "Nul ne peut être condamné pour une action ou une omission qui, au moment où elle a été commise, ne constituait pas une infraction d'après le droit national ou international . De mème il n'est infligé aucune peine plus forte que celle qui est applicable au moment où l'infraction a été commise - . Le requérant a été condamné pour un acte que les tribunaux nationaux ont considéré comme relevant de la définition de l'infraction prévue à l'article 27 de la loi sur les transactions immobiliéres . Il est exact que l'article 27 par . I qualifie d'infraction pénale le fait d'• éluder- l'obligation d'obtenir l'autorisation d'effectuer certaines transactions et que ceci peut sembler ne pas être une définition très précise de l'infraction . Cependant, il faut lire l'anicle 27 par . I en liaison avec l'article I par . 2 (d) de la méme loi et la Commission estime que, vue sous cet angle, la disposition légale était libellée en termes assez clairs pour permettre aux personnes à qui elle s'adresse de faire la différence entre un comportement licite et un comportement prohibé . Une législation afférente aux divers modes d'acquisition de biens immobiliers peut partir de l'hypothèse que les intéressés ont une connaissance spécifique de ces transactions . En l'espèce, le requérant, administrateur spécialisé dans les transactions immobilières, était en mesure d'apprécier si les transactions en question poursuivaient des -objectifs économiques analogues à ceux de l'acquisition de biens immobiliers• au regard de l'article 1 par . 2(d) de la loi . Il n'y a donc ici aucun élément d'incertitude excessive de la loi pouvant constituer une violation de l'article 7 par . I(voir requête No 8141/78 . Déc . 4 .2 .78, D .R . 16 p . 141) . Il s'ensuit qu'il n'y a pas, en l'espéce, apparence de violation de l'article 7 par . I et que le présent grief est manifestement mal fondé, au sens de l'anicle 27 par . 2 de la Convention . Par ces motifs, la Commissio n DÉCLARE LA REQUÉTEIRRECEVABLE .
