Summary of the relevant facts

The custody of the applicant's twin daughter was after divorce awarded to his ex-wife . Orr appeal brought by the applicant, the rnatter was refered back to the first in .nance court far further consultation bejore deciding which oj the parents would be entrusted with their custodv . After having obtained three psychiatric opinions-in addition to those established previously by Yutnh Ofjices-the court decided once more to entrust the childrert's custody to the rnother. A furdrer appeal to the Supreme Cou rt was also dismissed.
THE LAW (Extract ) I . The applicant has lirst complained that the determination of his civil right to child custody he has not had a fair hearing in the sense of Article 6 . paragraph I of the Convention . He refers in particular to the hearing of his children by the judge on I June 1979 which took place without his knowledge alter judgment had already been given . He therefore could not put any questions to the children nor comment on their answers . The Commission first observes that the fairness ol' civil proceedings must be judged on the basis of the development of the case as a whole and that an isolated incident cannot be seen as interfering with the principle of fairness unless it might have substanfially atTected the overall conduct of the proceedings or their result . In Ihe present case the Commission is not called upon to exaniine whether or not the domestic courts have correctly assessed the children's evidence, but only whether or not this evidence has been obtained in such a manner Ihat Ihe applicant's right to a fair hearing was thereby impaired .
The Contmission notes that, as the Regional Court ot' Vienna stated in its decision ot' 18 June 1979, the judge of first instance in fact comntitted an unlawful ontission by failing to hear the children prior to his judgment . The applicant raised this procedural defect in his appeal which, in accordance with Ihe general practice in Austria, must be filed with the court of first inslance . This court, which in non-contentious proceedings has power to redress the silualion complained of in an appeal by taking a new decision of its own, reacted by supplemenling its detective procedure . It therefore heard the children on f June 1979, asking them in particular whether they preferred to stav with their niother or their l'ather . Both contirmed what they had already previously said during a psychiatric examination, nantely Ihat they preferred Ihe mother . In these circumstances, the court saw no basis for revoking or antending ils earlier decision . The Regional Court which then had to examine the appeal Iound that the procedural defect complained ot' had been cured aud fherel'ore rejected the appeal . The applicant now complains that at the hearing in question he was not present aud therefore could not put any questions to his children . However th e

right to put questions to a witness in civil proceedings, as distinguished from criminal proceedings (ct' . Article 6, paragraph 3 .d) , is not as such guaranteed by the Convention . Nor does the Austrian law provide for such a right of the parties in non-contentious civil proceedings such as in the present case . In accordance with the nature of such proceedings, they are conducted in a very tlexible way and the judge has a wide discretion as to the circumstances in which he collects the evidence . It is not excluded that the parties may be present at a hearing ot'the kind in question, but the fact that the judge in the present case refrained trom exercising his discretion in this sense . does not, in the Commission's opinion, amount to a breach of the principle of fair hearing . Since it was the purpose of the hearing in question to find out with whom of the parents the children preferred to stay, it may indeed have been the proper course to exclude the influence of the interested parties and to hear the children in the absence of both parents . As the applicant does not allege that he was treated less favourably than his opposite party, namely his former wife, there is in particular no appearance of a violation of the fundamental principle of equality of arms which is an essential element of a fair hearing . The applicant has further complained that due to the pa rt icular circumstances in which the hearing of his children took place, he could not even comntent on the result of this hearing . It is true that he had no such oppo rt unity prior to the decision of tirst instance which was in fact made before the hearing in question and which the court saw no reason to change as a result of that hearing . It must, however, be noted that in no-contentious proceedings the decision of first instance is subject to full review by the higher cou rt , which has power to deal with every relevant argument as to fact and law . The applicant thus had an effective possibility to submit his point of view regarding the children's statements at least to the Regional Cou rt of Vienna . This court considered his appeal in which he had in fact commented on these statements . But as the applicant apparently failed to specify what kind of t'urther questions should have been put to the children, the cou rt did not feel prompted to order a t'u rt her hearing of them . The Commission considers that in these circumstances, there is no appearance of a violation of the principles of fair hea ri ng in this respect . either . The applicant's above complaint must accordingly be rejected as being manifestly ill-founded within the nteaning of Article 27, paragraph 2 of the Convention .

Résumé des faits pertinent s A la suite du divorce du requérati t, l'autorité parentale et la garde de ses deux ftlles ont été attribuées à son ex-épouse . Sur appel du requérant . l'affaire jut renvoyée au juge de prentière instance afin qu'il procède à de plus amples consultations avant de décider à qui les enjants seraieru conftées . Après (rois expertises psychiatriques - s'ajoutant aux avis antérieurs des ojfrces de la jeunesse -, lejuge prit une nouvelle décision confimu les enjants à leur mère . Le requératu iruerjeta à nouveau appel en faisaru valoir notamrnent que le juge avait ornis d 'enteudre les enjants elles-mBntes . Selon les règles de la procédure non contentieuse - . applicables en l'espèce - , le juge de prernière instance prit alors ( initiative d'entendre les enjants hors la préserrce de leurs parents et, cela fait, décida qu'il n ;y avait pas lieu de modiJier sa décision antérieure .
Sur ce , la cour d'appel estima que le vice de procédure avait été réparé, que la décision de première instance était solidement étayée et qu'il n ;v avait pas lieu de la réjorni er. Un recours ultérieur du requérant à la Cour supréme jut rejeté.

EN DROITS (Extrait) I . Le requérant s'est plaint en premier lieu de n'avoir pas bénéticié d'un procès équitable au sens de l'article 6, par . 1 de la Convention lorsque le tribunal a décidé de son droit à caractère civil concernant la garde de ses enfants . Il évoque notaniment l'audition de ses enfants par le juge, qui a eu lieu le ler juin 1979, à son insu et après le prononcé du jugement . Il n'a donc pas pu poser de questions aux enfants, ni comnienter leurs réponses . La Commission observe en premier lieu que le caractère équitable d'une procédure civile doit s'apprécier au regard du déroulement de l'ensemble de l'affaire et qu'un incident isolé ne saurait @tre considéré comme portant atteinte au principle de l'équité, à moins qu'il n'ait sensiblement affecté le déroulement global de la procédure ou son issue . En l'espèce, il n'échet pas à

la Conimission d'examiner si les tribunaux internes ont ou non correctement apprécié les témoignàges des enfants, mais seulement si ces témoignages ont été obtenus selon des modalités affectant le droit du requérant à bénéficier d'un procès équitable . La Commission relève que, comme l'a indiqué le tribunal régional de Vienne dans son arrêt du 18 juin 1979, le juge de première instance a ontis . conlrairement à la loi, d'entendre les enfants avant de rendre son jugement . Le requérant a relevé ce vice de forme dans l'appel que, selon la pratique autrichienne il a interjeté devant le tribunal de lère instance . Cette juridiction qui, dans les procédures non contentieuses, est habilitée à remédier à la situalion dont se plaint l'appelant en prenant de son propre chef une nouvelle décision, a réagi en palliant ce défaut de la procédure . Le juge a donc entendu les enfants le ler juin 1979, en leur dentandant notamment s'ils préféraient rester avec leur mère ou avec leur père . Tous deux confirmèrent ce qu'ils avaient déjà dit lors d'un examen ntené par le psychiatre . à savoir qu'ils préféraient leur mère . Dans ces conditions, le tribunal estinta qu'il n'y avait pas lieu d'annuler ou d'amender son jugement précédent . Le tribunal régional qui connut ensuite de l'appel . constata que le vice de forme en question avait été corrigé et rejela donc l'appel .
Le requéranl se plaint à présent que n'ayant pas assisté à l'audience en question, il n'a pas pu poser dé questions à ses enfanls . Cependant, la Convention ne garantit pas en tanttlue tel le droit de poser des questions à un témoin dans une procédure civile, contrairentent au cas de la procdure pénale (cf. Art . 6, par . 3(d)) . Le droit autrichien ne prévoit pas non plus ce droit pour les parties à une procédure civile de caractère non contentieux, comme c'est le cas en l'espèce . Cont'orméntent à leur nature, ces procédures sont ntenées avec beaucoup de souplesse et le juge peut librement décider des circonstances dans lesquelles il recueille les témoignages . Il n'est pas exclu que les parties puissent assister à une audition de ce genre, mais le t'ait qu'en l'espèce le juge ne l'a pas autorisé ne constitue pas, selon la Commission, une ntéconnaissance du principe de l'équité du procès . Comnie l'audience en question visait à déterntiner avec lequel des deux parents les enfants préféraient resler, il se peut que le juge ait bien fait d'exclure l'inlluence des interessés et d'entendre les enfants en l'absence des parents . Comnte le requérant n'allègue pas avoir été traité de maniére moins favorable que la partie adverse, son exépouse, il n'v a notantnient pas apparcnce de violation du principe fondantental de l'égalité des armes qui est un élément essentiel d'un procès équitable . Le requérant s'esl plaiut en outre, qu'en raison des circonstances parti . culières de l'audiliou de ses enfants, il n'a même pas pu commenter le résultat de cette audition . Il est exact qu'il n'a pas eu cette possibilité avant le prononcé du jugentent de lère instance puisqu'en fait ce dernier lut antérieur à l'audition en questiou, et que, pour le tribunal, il n'y avait pas lieu d' y

ntoditier quoi que ce soit après l'audition . Il faut relever cependant que, dans une procédure non contentieuse, le jugement de lère instance est susceptible d'ètre revu dans son intégralité par la juridiction supérieure, laquelle est habititée à examiner le fait comme le droit . Le requérant avait donc la possibilité réelle de présenter son point de vue sur les déclarations de ses enfants, au ntoins devant le tribunal régional de Vienne . Cette juridiction a examiné son appel où il exposait de t'ait son point de vue sur ces déclarations . Cependant, comme le requérant ne semble pas avoir précisé le genre de questions complémentaires qu'il aurait lallu poser aux ent'ants, le tribunal n'a pas cru bon d'ordonner une nouvelle audition . La Commission estinie que, dans ces conditions, il n'y a pas à cet égard non plus, apparence de méconnaissance des principes de l'équité du procès . Ce grief du requérant doit donc être rejeté comme manifestement mal fondé au sens de l'article 27, par . 2, de la Convention .
