EN FAIT
Le requérant, de nationalité belge, est né en 1949 . Lors de l'introduction de sa requête, il était détenu à la prison d'Audenarde . Il est représenté devant la Commission par Me J .M . Van Damme, avocat au Barreau de Gand . Enfant illégitime, le requérant a été délaissé par sa mère et confié à une famille d'accueil par le juge des enfants . Alors qu'il avait huit ans, sa mère, qui s'était mariée, a exigé à nouveau la garde de son enfant . Dès lors, il habita chez sa mère et porta contre son gré le nom de son beau-père . Suite à des difficultés avec son enfant, la mère a demandé l'intervention du juge des enfants et son placement dans un établissement . Le requérant a été successivement confié aux institutions de reclassement de Ruislede et de Mol et placé dans un home à Lokeren . Plus tard il s'est mal adapté à la discipline lors de son service militaire et fut profondément affecté par la mort soudaine de sa fiancée . Il s'adonna à la boisson et, depuis 1968, a fait l'objet de plusieurs condamnations, principalement pour vol et vol qualifié .

Par un jugement du tribunal comectionnel de Turnhout, du 6 septemb re 1972, le requérant a été condamné à une peine d'emp ri sonnement d'un mois pour tentative de vol qualifié et placé à la dispositi on du Gouve rn ement pour une période de cinq ans, en application de l'a rt icle 23 de la loi du 1" juillet 1969 ( Loi de Défense sociale) comme étant en état de récidive légale . Deux autres mesu re s de mise à la disposition du Gouve rn ement ont été prononcées con tr e le requérant : l'une pour une durée de dix ans prononcée par la cour d'appel de Gand le 27 novembre 1972 en même temps qu'une peine de prison de trois ans pour vol qualifié, l'aut re é galement pour une durée de dix ans prononcée par la cour d'appel de Gand le 31 mars 1980 en même temps qu'une peine de p rison de t ro is ans pour vol qualifié . Les différentes mesures précitées étant cumulables, le requérant se trouve ainsi à la disposition du Gouvemement pour une durée totale de vingt-cinq ans, interrompue par des peines d'emprisonnement . Par ailleu rs , il a été encore condamné le 6 décembre 1977 à une peine de tre ize mois d'emp ri sonnement pour vol avec violences par le t ribunal corre ctionnel d'Anve rs . A la fin de cett e dernib re peine, le 1 - décembre 1978, il a été effectivement interné à la section pour récidivistes de l'établissement pénitentiaire de Merksplas sur ordre du Ministre de la Justice, en application de l'a rticle 25 de la Loi de Défense sociale, qui est ainsi libellé : . Les récidivistes et délinquants d'habitude se trouvant à la disposition du Gouvernement sont inte rnés, s'il y a lieu, dans un établissement désigné par arrêté royal . . Le le r février 1979, le re quérant a é té transféré sur sa demande à la p ri son de Malines, é tant donné qu' il ne s'adaptait pas au m il ieu pénitentiaire de Merksplas où il avait un comportement agressif . Le 24 avril 1979, le re quérant a comparu devant la commission spéciale pour récidivistes mis à la disposition du Gouvernement, à l'établissement pénitentiaire de Merksplas o ù il avait é té à nouveau transféré . Cette commission a constaté l'absence d'un plan de re classement et décidé d'ajourner l'examen de sa situation au mois de novembre 1979. Cette décision fut mal acceptée par le requérant qui exigea d'être à nouveau transféré à la p ri son de Malines, tout en refusant de solliciter ce transfe rt auprès du se rv ice compétent de l'Administration centrale . Le 2 mai 1979 il a tenté de se suicider en p re nant une dose excessive de somnifères et a été envoyé à la section psychiat ri que de la p ri son . Il a quitté cette section le 4 mai 1979 sur l'avis du médecin anthropologue . Le 8 mai 1979, il a so0icité un entretien avec la direction de Mersplas . Vu ses menaces de se blesser et de s'en prendre au directeur de la section, il a

été placé en cellule d'observation sous surveillance spéciale et constante pendant huit jours . La blessure qu'il s'était faite au moyen de son rasoir fut suturée . Plus tard il se plaignit d'hallucinations . Le 21 mai 1979 il a été à nouveau transféré à la prison de Malines . Au début du mois de juin 1979, le requérant, qui se plaignait toujours d'hallucinations, a été transféré à l'annexe psychiatrique de la prison d'Anvers . fx médecin anthropologue le décrivit comme une personnalité psychopatique instable, socialement inadaptée, affectivement pauvre, égocentrique et agressive, présentant de légères tendances interprétatives, sans toutefois constater d'hallucinations caractérisées . Il consei]la le transfert du requérant à Termonde, établissement pénitentiaire à'égime libéral, mais conclut que l'état de santé mentale du requérant ne nécessitait pas son placement dans un établissement de Défense sociale . Le requérant a été transféré au début du mois de juillet 1979 à l'établissement pénitentiaire d'Audenarde . Le 4 septembre 1979, le requérant a comparu à nouveau devant la commission spéciale pour récidivistes mis à la disposition du Gouvernement à Merksplas, qui a décidé de revoir le cas après enquête sociale concernant les possibilités de reclassement professionnel du requérant . Lors de sa séance du 6 novembre 1979, la commission a émis un avis favorable à sa libération . Le 26 septembre 1979 un rapport anthropologique a été établi par le service compétent auprès des établissements pénitentiaires à Merksplas, faisant état d'une personnalité psychopatique, bien orientée dans le temps et dans l'espace, sans autocritique ni idées délirantes ou hallucinatoires . Le médecin anthropologue fut d'avis que le requérant devait être soumis à un contrôle féguher et s'abstenir totalement des boissons alcoolisées, afin d'assurer une intégration sociale raisonnable . Conformément à l'avis exprimé par la commission, le Ministre de la Justice a décidé d'accorder au requérant un congé d'un mois, renouvelable . Il a été libéré sous la double condition de résider auprès de ses parents (la mère exploite un débit de boissons) et de travailler régulièrement. Aucune mesure ne fut ordonnée pour le suivre et l'aider après sa libération . fx requérant fut arrêté pour vol qualifié le 6 décembre 1979 . A la suite de cette infraction, il fut condamné à trois ans de prison et dix ans de mise à la disposition du Gouvernement, par jugement rendu le 15 janvier 1980 par le tribunal correctionnel de Gand . Le requérant a fait appel de ce jugement . Le conseil du requérant déclare avoir constaté que ce dernier souffrait manifestement d'une maladie mentale, ce que l'administration de la prison de Gand aurait confinné officieusement, faisant état d'un traitement pour une psychose se manifestant par des hallucinations auditives . Toutefois, comme une circulaire ministérielle du 26février 1959 interdit aux médecins anthropologues des établissements pénitentiaires de Défense sociale d'accepter des missions d'ex-

pertise demandées par un détenu, son conseil ou un membre de sa famille, son conseil aurait été dans l'impossibilité de soumettre un rapport médical à la cour d'appel, le requérant n'ayant pas les moyens de rémunérer un médecin psychiatre de son choix . Le 21 mars 1980, le conseil du requérant a déposé une requête en application de l'article 1 de la loi de Défense sociale, demandant la mise en observation du requérant dans l'annexe psychiatrique de la prison de Gand . Par décision du 31 mars 1980, la cour d'appel a rejeté cette demande au motif qu'elle n'était basée sur aucune donnée concrète comme l'avait soutenu le parquet . En outre, par arrét du même jour, elle a confirmé le jugement du tribunal de Gand du 15 janvier 1980 . A la suite de cette condamnation, les hallucinations auditives du requérant ont réapparu et un rapport anthropologique a été demandé par le directeur de la prison de Gand . Le 21 avrll 1980, le médecin anthropologue que la prison qui avait suivi le requérant depuis le débus du mois de janvier, a envoyé son rapport au directeur en déclarant que le requérant souffrait de troubles hallucinatoires auditifs chroniques, aggravés par la situation de détention . Il a proposé l'internement pour un traitement par neuroleptiques . Le 25 avril 1980 le requérant a été transféré à la prison de Termonde pour y subir sa peine . Constatant que le requérant s'adaptait bien à l'établissement, le médecin anthropologue de la prison, à qui le rapport du 21 avril 1980 avait été transmis, a proposé d'adopter une attitude d'attente avant d'envisager une mesure d'internement éventuelle, qui ne changerait guère la situation du requérant, d'autant plus que le traitement nécessaire pouvait être administré à la prison même . A la fin du mois de mai 1980, le requérant a fait une grève de la faim de quelques jours . Il a été transféré à l'annexe psychiatrique de la prison de Gand où, après deux semaines d'observation, le médecin anthropologue a préconisé son renvoi à l'établissement pénitentiaire d'Audenarde . Le transfert a été effectué le 23 mai 1980 . Dans son rapport du 24 juin 1980 le médecin anthropologue a constaté que l'état mental du requérant, qui se déclarait prêt à prendre des médicaments, était raisonnable et que les symptômes psychotiques allaient en diminuant . En outre, il était d'avis que le transfert du requérant à la prison de Termonde, comme ce dernier l'avait demandé, n'était pas opportun . A plusieurs reprises, le requérant a demandé à nouveau à être transféré à la prison de Termonde . Son transfert a eu lieu le 5 septembre 1980, sur avis du médecin anthropologue qui estimait qu'un changement d'environnement pouvait lui être bénéfique et que le service compétent de cette prison, où il était déjà connu, pouvait assurer sa prise en charge psychologique .

Au mois de janvier 1981, le requérant a été placé en observation à l'annexe psychiatrique de la prison de Gand, suite à une recrudescence des symptômes psychotiques . Egalement au mois de janvier 1981, i1 a été placé durant deux semaines en observation à l'annexe psychiatrique de la prison de Termonde puis réintégré à la prison après que son état se soit stabilisé . Au début du mois de juin 1981, le requérant a été informé que le congé pénitentiaire systématique qu'il avait sollicité avait été jugé prématuré . Il a réagi à cette décision par un refus de travailler et les symptômes hallucinatoires sont réapparus . Il a été immédiatement transféré à l'annexe psychiatrique de la prison de Gand en vue de son internement éventuel dans un établissement de Défense sociale, en application de l'article 21 de la loi de Défense sociale . Ix médecin anthropologue de cet établissement, constatant l'atténuatio n des symptômes sous l'effet de la médication prescrite, a estimé le 23 juin 1981 que le requérant pouvait, sous médication, @tre à nouveau intégré dans le régime pénitentiaire de la prison de Termonde, ce qui fut fait . Le 16 novembre 1981, le médecin anthropologue de la prison de Termonde a émis un avis favorable à un congé pénitentiaire systématique demandé par le requérant . Bien qu'il eGt été logique d'envoyer le requérant •en psychiatrie ., le médecin jugeait pareille mesure impossible, ne fGt-ce que parce que le requérant appréhendait le risque de rester interné . A son avis, un congé pénitentiaire non seulement correspondait à un droit légal, mais pouvait aussi être opportun, pour des raisons humanitaires et médicales . GRIEFS 1.
Les mesures de mise à la disposltion du Gouvernemen t
Le requérant se plaint d'avoir été privé de sa liberté en violation de l'article 5 . paragraphe 1, de la Convention, son intemement ne pouvant être couvert par l'alinéa a) de cette disposition . En effet, la décision judiciaire de mise à la disposition du Gouvernement n'ordonne pas la privation de liberté ; elle laisse au pouvoir exécutif la faculté d'intemer effectivement le condamné durant dix années ou de le laisser en liberté pour tout ou partie de cette période . Le requérant fait valoir également une violation de l'article 5, paragraphe 4 . Le condamné interné peut uniquement se pourvoir devant le Ministre de la Justice et, le cas échéant, devant le Conseil d'Etat, mais de tels recouts ne sont pas conformes, selon lui, aux exigences du contrôle judiciaire de légalité prévu par cette disposition .

Le requérant allègue également être placé dans un état de servitude prohibé par l'article 4 . paragraphe 1, et avoir été astreint à accomplir un travail forcé ou obligatoire en contravention à l'article 4 . paragraphe 2. Traitement médica l Le requérant soutient enfin avoir été détenu sans intermption depuis le mois de mai 1979 sans traitement médical adéquat bien que l'administration pénitentiaire sache qu'il présente de sérieux symptômes de déficience mentale et, en particulier, d'état psychotique . La mise en régime cellutaire strict après sa deuxième tentative de suicide et le refus de le placer en observation illustreraient l'attitude des autorités à son égard . Il invoque l'article 3 de la Convention .
EN DROIT (Extrait) La mise à la disposition du Gouvememen t Le requérant se plaint d'avoir été privé de sa liberté en violation de l'article 5, paragraphe 1, de la Convention, son internement ne pouvant être justifié par l'alinéa a) de cette disposition qui vise la détention d'une'personne après condamnation par un tribunal compétent . En effet, la décision judiciaire de mise à la disposition du Gouvernement n'ordonne pas la privation de liberté ; elle laisse au pouvoir exécutif la faculté d'interner effectivement le condamné durant dix années ou de le laisser en liberté pour tout ou partie de cette période . Le requérant allègue également être placé dans un état de servitude prohibé par l'article 4, paragraphe 1, et avoir été astreint à accomplir un travail forcé ou obligatoire en contravention de l'article 4, paragraphe 2 . Le requérant soutient, en outre, avoir été détenu depuis le mois de mai 1979 à ce jour sans traitement médical adéquat, alors que les autorités pénitentiaires savaient qu'il présente de sérieux symptômes de déficience mentale et, en particulier, d'état psychotique . Sa mise au régime cellulaire strict après sa deuxième tentative de suicide et le refus de le placer en observation constituent des aspects particuliers de ce grief . Le requérant invoque à cet égard l'article 3 de la Convention, qui interdit qu'une personne soit soumise à la torture ou à des peines ou traitements inhumains ou dégradants . Selon le Gouvernement, la requête doit être déclarée irrecevable pour non-épuisement des voies de recours internes que le requérant a eu à sa disposition pendant les différentes périodes d'internement et de détention et dont il dispose encore .

a) La période de mai 1 979 à novembre 1 979 pendant laquelle le requérant était interné comme récidivis[ e Le Gouvernement a soutenu que pendant cette période le requérant lui-même ou son conseil auraient pu adresser une requête au Ministre de la Justice en vue de demander un placement en milieu psychiatrique en application de l'arrêté du Régent du 5 avril 1949 . Aux termes de l'article 1 de cet arrêté : . Les récidivistes et les délinquants d'habitude de sexe masculin, mis à la disposition du Gouvernement par application des articles 24 et 25 de la loi du 9 avril 1930 (ces dispositions ont été reprises telles quelles aux articles 22 à 26 de la loi du 1° 1 juillet 1964 de Défense sociale à l'égard des anormaux et délinquants d'habitude), pour lesquels il existe des raisons de croire qu'ils sont en état de démence ou dans un état grave de déséquilibre mental ou de débilité mentale, les rendant incapables du contrôle de ]eurs actions, seront internés dans les établissements de défense sociale à Rehen (supprimé depuis) et à Tournai» . Le requérant prétend qu'aucun recours judiciaire n'est ouvert lui permettant de remédier à son cas, la Belgique ne connaissant pas le juge d'exécution des peines . Toutefois, dans ses observations, le conseil du requérant a concédé que le Ministre de la Justice qui avait le pouvoir de placer le requérant sous la tutelle de la commission de Défense sociale qui pouvait le placer dans une institution privée, aurait pu autoriser la libération du requérant, à condition qu'il soit soigné dans un établissement psychiatrique privé . La Commission constate que le requérant admet ainsi qu'il existait un recours pouvant aboutir au résultat recherché . Le requérant prétend, il est vrai, avoir écrit à plusieurs reprises au Ministère de la Justice, sans avoir jamais eu de réponse . Toutefois, contre une décision négative du Ministre ou en l'absenc e d'une réponse il aurait pu introduire un recours devant le Conseil d'Etat (article 14 de la loi sur le Conseil d'Etat) en invoquant notamment l'article 3 de la Convention . La Commission est donc d'avis qu'en négligeant ce recours, le requérant n'a pas épuisé toutes les voies de recours internes (article 26 de la Convention) durant la période de sa mise à la disposition du Gouvernement . Il s'ensuit que le requérant n'a pas satisfait à la condition de l'épuisement des voies de recours internes et que sa requête doit être rejetée sur ce point conformément à l'article 27, paragraphe 3, de la Convention . b) La période de détention durant laquelle le requérant a purgé une peine de trois ans. du 6 décembre 1 979 à ce jou r Le conseil du requérant a introduit le 21 mars 1980 devant la cour d'appel de Gand une requête visant à obtenir la mise en observalion de l'intéressé dans l'annexe psychiatrique de la prison de Gand .

Par arrêt du 31 mars 1980 cette requête a été rejetée . Le requérant ne s'est pas pourvu en cassation contre cet arrêt, ce qu'il aurait pu faire en invoquant, le cas échéant, l'article 3 de la Convention . D'autre part, le Gouvemement a soutenu qu'une requête, émanant de l'inculpé ou de son conseil, demandant l'application de l'article 21 de la Loi de Défense sociale (mise en observation à l'annexe psychiatrique d'un condamné pour crimes et délits) peut être adressée au Ministre de la Justice . De son côté, dans ses commentaires du 9 mai 1981 sur les renseignements fournis par le Gouvemement défendeur, le conseil du requérant a déclaré : . récemment d'ailleurs l'administration a libéré un détenu condamné à une lourde peine d'emprisonnement avant qu'un tiers de sa peine soit écoulé parce qu'un emprisonnement prolongé aurait eu des suites graves pour son état de santé . Un traitement du requérant dans un établissement psychiatrique privé et spécialisé en la matière est donc parfaitement possible en droit belge . . . . . Il ressort donc des déclarations des deux parties qu'une demande adressée au Ministre de la Justice pouvait avoir comme résultat que le requérant soit transféré dans un établissement spécialisé . Bien que le requérant prétende avoir écrit au Procureur du Roi et au juge d'instruction, ni lui ni son conseil n'ont indiqué qu'une telle demande a été adressée au Ministre .
A ce propos, la Commission considère qu'un recours devant le Conseil d'Etat au cas d'un refus ou d'absence de réponse de la part du Ministre était possible, en se fondant au besoin sur l'article 3 de la Convention . La Commission estime donc que le requérant n'a pas épuisé les voies de recours internes en ce qui concerne la période en question . 1l s'ensuit que le requérant n'a pas satisfait à la condition de l'épuisement des voirs de recours internes et que sa requête doit être rejetée sur ce point conforrnément à l'article 27, paragraphe 3, de la Convention .

THE FACTS The applicant is a Belgian citizen who was born in 1949 . When he lodged his application he was detained in the prison at Audenarde . He is represented before the Commission by Mr J .M . Van Damme, a lawye r practising at the Ghent Bar . The applicant, who was an illegitimate child, was abandoned by his mother and placed in the care of a foster family by the juvenile court . When he was eight years old, his mother, who had married, asked for the care of her child again . Thereafter he lived with his mother and bore his step-father's name against his will . As a result of difficulties with her child, the mother asked the childrens' judge to intervene and have him placed in an institution . The applicant was placed successively in the rehabilitation institutions at Ruislede and Mol and finally in a home at Lokeren . Subsequently he fôund it hard to adjust to discipline during his military service and was deeply affected by his fiancéé s sudden death . He took to drink and, since 1968, has been couvicted on several occasions, mainly of theft and robbery . By a judgment of the criminal court at Turnhout, dated 6 September 1972, the applicant was sentenced to one month's imprisonment for attempted aggravated theft and placed at the Governinent's disposal for five years, in pursuance of Article 23 of the Law of I July 1969 (Social Defence Law), as a recidivist . Two other measures were taken against the applicant placing him at the Govemment's disposal : One for ten years by order of the Cou rt of Appeal at Ghent on 27 November 1972, at the same time as a prison sentence of three years for robbery ; the other, also for ten years, by order of the Court of Appeal at Ghent on 31 March 1980, at the same time as a p ri son sentence of three years for robbery . Since the various measures referred to above ran consecutively, the applicant was placed at the Government's disposal for a total period of twenty live years, interrupted by the prison sentences . Fu rt hermore, he was sentenced once again, on 6 December 1977, to a term of imprisonment of thirt een months for robbe ry with violence by the Criminal Court at Antwerp . After completing this last sentence, on I December 1978, he wa s detained in the recidivists' wing of Merksplas prison by order of the Ministe of Article 25 of the Social Defence Law which reads rofJusticenpa: "Recidivists and habitual offenders placed at the Government's disposal shall be detained, where appropriate, in an establishment designated by Royal Decree ."

On I February 1979, the applicant was transferred, at his request, to the prison at Malines, in view of the fact that he was unable to adjust to the prison environment at Merksplas, where he had behaved aggressively . Ou 24 April 1979, the applicant appeared before the special Board for recidivists placed at the disposal of the Govemment at Merksplas prison, to which he had been transferred once again . The Board found that no plan existed tor his social reintegration and decided to defer its examination of his case until November 1979 . This decision was taken badly by the applican who again requested a transfer to the prison at Malines, although he refused to apply to the competent depanment of the Central Administration for this transfer . On 2 May 1979 he tried to commit suicide by taking an overdose of sleeping pills and was moved to the psychiatric section of the prison . He left this sectiou on 4 May 1979 following an opinion given by the doctor specialised in psvchology (médecin anthropologue) . On 8 May 1979, he asked for an inte rv iew with the Merksplas prison Board . Since he threatened to injure himself and to att ack the head of the section, he was placed in an obse rvation cell under special, constant su rveillance lor eight days . When he injured himself with his razor, the wound was stitched . Subsequently he complained of hallucinations .
On 21 May 1979 he was once again transferred to the prison at Malines . Early in June 1979 the applicant, who was still complaining of hattuciuations, was transterred to the psychiatric wing of Antwerp prison . The doctor, specialised in psvchology, described him as an unstable psychopath, socially matadjusted, emotionally retarded, egocentric and aggressive, displaying slight interpretative tendencies, although he did not find evidence of marked haltucinations . He advised that the applicant should be transferred to Termonde, a prison with a liberal regime, but concluded that the state of the applicant's ntental health did not make it necessary for him to be placed in a Social Det'ence institution . The applicant was transferred to the prison at Audenarde early in Jul y
1979 . On 4 September 1979, the applicant appeared again before the special Board tor recidivists placed at the Government's disposal at Merksplas, which decided to review the case after an inqui ry into the possibilities for the applicant's vocational rehabilitation . At its session on 6 November 1979, the Board declared itself in favour of his release . On 26 September 1979 a psychological report was drawn up by the competent depa rt ment attached to

the prison iustitutious at Merksplas . It referred to the applicant as a psychopath, well oriented in tinte and space, who was not prone to self criticism or to delirious or hatlucinatory ideas . The doctor specialised in psychology was of the opinion that (he applicant should be kept under regular supervision and completely refrain front taking alcoholic beverages, in order to ensure his satisfactory social integration . In accordance with the Board's opinion, the Minister of Justice decided to grant the applicant one month's leave, on a renewable basis . He was released, subject to the dual condition that he lived with his parents (the mother runs a bar) and worked regularly . No steps were taken to follow hint up and assist him after his release . The applicant was arrested for robbery on 6 December 1 979 . As a result of that offence, he was sentenced to three years' intprisonment and then years at the Government's disposal, in a judgment delivered on 15 January 1980 by the crintinal court at Ghent . The applicant appealed against that judgment . Couusel for the applicaut said he had found that the latter was obviously sut7èring from a mental disorder and this had been allegedly unofficially contirmed by the prison administration in Ghent . when it referred to treatment for a psychosis, which took the form of auditory hallucinations . However, since a ministerial circular of 26 February 1959 prohibits doctors specialised in psychology at Social Defence prisons from agreeing to act as experts if asked to do so by a prisoner, counsel or a member of his family, counsel for the applicant allegedly found it impossible to submit a medical report to the Court of Appeal, since the applicant did not have the means to remunerate a psychiatrist of his own choosing .
On 21 March 1980, counsel for the applicant lodged an application under Article I of the Social Defence Law, asking for the applicant to be placed under observation in the psychiatric wing at Ghent . By its decision of 31 March 1980, the Court of Appeal rejected this request on the grounds that as the Public Prosecutor's Office had submitted, it was not based on any concrete fact . Furthermore, by decision of the same dav, it upheld the judgment of the tribunal at Ghent dated 15 January 1980 . Following that conviction, the applicant's auditory hallucinations reappeared and the Governor of the prison at Ghent asked for a psychological report . On 21 April 1980 . the prison doctor specialised in psychology, who had followed the applicant since the beginning of January, sent his report to the Governor stating that the applicant was suffering from chronic auditory, hallucinatory disturbances, aggravated by the prison environment . He proposed detention for neuroleptic treatment . On 25 April 1980 the applicant was transferred to the prison at Termonde to serve his sentence . Since he found that the applicant was

adjusting himself well to the institution, the prison doctor specialised in psychology, to whom the report of 21 April 1980 had been sent, suggested adopting a"wait-and-seé' attitude before considering transfer for treatment, which would in auy case scarcely alter the applicant's situation, since the necessary treatment could be administered in the prison itself . At the end of' May 1980 . the applicant went on hunger strike for several days . He was transferred to the psychiatric wing of the prison at Ghent where, after two weeks' observation, the doctor specialised in psychology proposed that he should be seut back to the prison at Audenarde . The transfer took place on 23 May 1980 . In this report dated 24 June 1980 the doctor specialised in psychology declared that the state of the applicant, who said that he was ready to take drugs, was reasonable and that the psychotic symptoms were becoming less marked . Furtherntore, he was of the opinion that it was not desirable to transfer the applicaut to the prison at Termonde, as the latter had requested . On several occasions, the applicant again asked to be transferred to the prisou at Termoude . His transfer took place on 5 September 1980 on the advice of the doctor specialised in psychology, who thought that a change of environment might be beneficial to him and that the competent department in that prison, where he was already known, could arrange for him to receive psychological treatment . In January 1981, the applicant was placed under observation in the psychiatric wittg of the prison at Ghent, when psychotic symptoms became more marked again . Also, in January 1981, he was placed for two weeks under observation iu the psychiatric wing of the prison at Ternionde, before being sent back to the prison when his state became stable again .
Early in June 1981 the applicant was informed that his application for svstematic leave front prison was judged premature . He reacted to this decision by refusing to work and the hallucinatory symptoms reappeared . He was immediately transterred to the psychiatric wing of the prison at Ghent with a view to possible detention in a Social Defence institution in pursuance o( Article 21 of the Social Defence Law . The doctor in that institution noticed that the symptonts had become less acute thanks to the drugs prescribed, and was of the opinion, on 23 June 1981 . that, if the applicant continued to receive drugs, he could once again be integrated into the penitentiary system of the prison at Termonde . This was in fact ordered . On 16 November 1981, the doctor specialised in psychology at the prison in Termonde expressed himself in favour of systematic prison leave, as requested bv the applicant . Although it would have been logical to send the appficant for "psychiatric treatment" . the doctor thought this impossible, if only because the applicant was afraid of being kept in detention . In his view , - 7f -
leave from prison not only seemed to conespond to a legal right but might also be desirable for humanitarian and ntedical reasons . At the present time the applicant is still detained in the prison at Termonde . COMPLAINTS The placing of a person at the Govemment's disposal The applicant complains that he was deprived of his liberty in violation of Article 5(1) of the Couvention, since his detention could not be justilied by sub-paragraph (a) of that provision . The judicial decision, placing him at the Govemment's disposal, did not order deprivation of liberty ; it left it to the executive power to detain the convicted person for ten years or allow him to remain at liberty for all or part of that period . The applicant also submits that there was a violation of Article 5 (4) . A detained, convicted person can only appeal to the Minister of Justice and, where appropriate, before the Council of State, but, in his view, such appeals are not in conformity with the requirements of the judicial control of lawtûlness provided for under that provision . The applicant also alleges that he was placed in a state of servitude, prohibited by Article 4(1), and required to perform forced or compulsory labour, in contravention of Article 4 (2) . Medical treatment Lastly the applicant submits that he has been detained, without interruption since May 1979, without adequate medical treatment, although the prison administration is well aware that he displays serious symptoms tif meutal deficiency and, in particular, of a psychotic state . The fact that he was placed in a cell under strict supervision after his second suicide attempt, and the refusal to place him under observation, allegedly illustrate the authorities' attitude towards him . He invokes Article 3 of the Convention

The placing of a person at the Government's disposal The applicant complains that he was deprived of his liberty in violation of Article 5(1) of the Convention, since his detention could not be justified under paragraph (a) of that provision, which concerns the detention of a person after conviction by a competent court . The judicial decision to place a

persou at the disposal of the Government does not order deprivation of liberty ; the executive power is free to detain the convicted person for ten years or to leave him at liberty for all or part of that period . The applicant also alleges that he was held in a state of servitude, which is prohibited under Article 4 (1), and required to perform forced or compulsory labour, in contraveutiou of Article 4 (2) . The applicant further submits that he has been detained, since May 1979 untit the present day, without adequate medical treatment, although the prison authorities knew that he was displaying serious symptoms of mental deticiency and, in particular, ot' a psychotic state . The specific features of this complaint concern his detention under strict supervision in a cell after his second suicide attempt and the refusal to place him under observation . In this counectiou the applicant invokes Article 3 of the Convention, which states that no one shall be subjected to torture or to inhuman or degrading treatntent or puuishmeut . In the Governmeut's view, the application must be declared inadmissible, because of the applicant's failure to exhaust the dontestic remedies at his disposal during the various periods of detention and imprisonment, and still available to him now . a . The Government submitted that during that period the applicant himself or couusel, could have lodged an application with the Minister of Justice seeking his placenteut in a psychiatric ward, in pursuance of the Regent's Decree of 5 April 1949 . Uuder Article I of that Decree : "Male recidivists or habitual offenders placed at the disposal of the Government under Article 24 and 25 of the Law of 9 April 1930 (these provisions were incorporated as a whole into Articles 22-26 of the Social Det'euce Law of I July 1964 in respect of abnormal persons and habitual otfeuders), in respect of whom there is reason to believe that they are in a state of insanity or serious mental instability or mental debility, making theni incapable of controlling their actions, shall be detained in the Social Defeuce institutions at Rehen (subsequently deleted) and Tournai" . The applicant claims that no judicial avenue of appeal is open to him to euable hint to remedy his case, since Belgium does not have judges responsible for the executiou of sentences . However, in his observations, counsel for the applicaut couceded that the Minister of Justice, who had the power to place the applicaut uuder the supervision of the Social Defence Board, which could place him in a private institution, could have authorised the applicant's release, provided that he was cared for in a private psychiatric institution .

The Commission finds that the applicant thus admits the existence of a remedy which might have achieved the desired result . Admittedly, the applicant alleges that he wrote on a number of occasions to the Ministry of Justice without ever receiving a reply . Nevertheless, in the event of a negative decision by the Minister, or in the absence of a reply, he could have appealed to the Council of State (Article 14 of the Council of State Law) by invoking, in particular . Article 3 of the Convention . The Commission is, therefore, of the opinion that, by neglecting this remedy, the applicant did not exhaust all domestic remedies (Article 26 of the Conventiou) during the period when he was placed at the Government's disposal . It follows that the applicant has not satisfied the condition of exhausting domestic remedies and that his application must be dismissed on this count . in accordance with Article 27 (3) of the Convention . b . On 21 March 1980 counsel for the applicant lodged a request with the Court of Appeal at Ghent for his client to be placed under observation in the psvchiatric wing of the prison at Ghent . That application was rejected by order of 31 March 1980 . The applicant did not appeal to the Court of Cassation against that decision, as hecould have done by invoking, where appropriate . Article 3 of the Convention . Furthermore, the Government submitted that an application from the accused, or his counsel, asking for the implementation of Article 21 -of the Social Detence Law (ptacing of a person, convicted of offences and misdemeanours, under observation in the psychiatric wing) can be addressed to the Miuister of Justice . For his part, in his observations of 9 May 1981 on the information f'uruished by the respondent Government, counsel for the applicant said : . . . recently, ntoreover, the administration released a prisoner sentenced to a loug term of imprisoument before he had served a third of his sentence, because prolonged imprisonment would have had serious effects on his state of health . Treatment of (he applicant in a private and specialised psychiatric iustitution is therefore perfectly possible under Belgian law . . ." . It follows therefore from the declarations of the two parties that a request addressed to the Minister of Justice could result in the applicant being transferred to a specialised institution .

Although the applicant alleges that he wrote to the Public Prosecutor and the iuvestigatiug judge, neither he nor counsel has stated that such a request was addressed to the Minister . In this connection, the Commission considers that in the event of a refusal or the absence of reply on the part of the Minist'er, an appeal before the Council of State was possible, based, if need be, on Article 3 of the Convention . The Commission, therefore, finds that the applicant did not exhaust domestic remedies in respect of the period concerned . It tollows that the applicant did not comply with the requirement that all domestic remedies should be exhausted and that his application must be dismissed on this couut, iu accordance with Article 27 ( 3) of the Convention .
