Les faits de la cause tels qu'ils ont été exposés par le requérant, peuvent se résumer comme suit : Le requérant, resso rtissant belge né le 18 juillet 1935, est avocat au barreau de Gand et prêtre séculier de l'Eglise catholique . Il est domicilié à Gand .

Le requérant a obtenu le diplôme de docteur en droit à l'Université de l'Etat à Gand le 6 juillet 1959 . Il a prêté serment comme avocat le ler novembre 1959 . A partir de cette date il a été admis contme avocat-stagiaire . Le 16 septembre 1963, il a été inscrit au tableau des avocats du barreau de Gand . Le 6 juillet 1968, le requérant a été ordonné prêtre de l'Eglise catholique . Il n'a jamais exercé de tâches pastorales . Par contre, il exerce toujours la profession d'avocat . En juillet 1969, le requérant a obtenu un doctorat en droit canon et une licence en droit social . En septembre 1969 il a été nommé maitre de conférence à l'Université catholique de Louvain . Le 30 mars 1978, le requérant a présenté sa candidature à un poste vacant de juge suppléant au tribunal de première instance de Gand . Le 31 juillet 1978, le Ministre de la Justice a informé le requérant que, vu les dispositions des articles 293 et 300 du Code judiciaire, il ne lui était pas possible de le proposer pour ce poste . En effet, le requérant réunit les conditions prévues par le Code judiciaire pour exercer les fonctions de juge suppléant, à l'exception de celles posées par les articles 293 et 300 de ce code qui créent une incompatibilité, entre autres, entre les fonctions judiciaires et l'état ecclésiastique . Les articles 293 et 300 du Code judiciaire se trouvent au chapitre If (Des incompatibilités), section première ( Du cumul) du Code judiciaire . Ils disposent : Article 293 - - Les fonctions de l'ordre judiciaire sont incompatibles avec l'exercice d'un mandat public conféré par élection ; avec toute fonction ou charge publique rémunérée, d'ordre politique ou administratif, avec les charges de notaire ou d'huissier de justice, avec la profession d'avocat, avec l'état militaire et avec l'état ecclésiastique . Ces fonctions sont également incompatibles lorsqu'elles sont exercées dans une juridiction du travail avec toute fonction dans une organisation représentative de travailleurs salariés, de travailleurs indépendants ou d'employeurs ou dans un organisme qui participe à l'exécution de la législation en matière de sécurité sociale . La règle énoncée à l'alinéa 2 n'est pas applicable aux fonctions exercées dans les organisations qui y sont prévues lorsque celles-ci ont exclusivement trait aux intérêts des personnes qui exercent des fonctions judiciaires . Article 300 - . Les juges suppléants sont soumis aux mêmes règles d'incompatibilité que les juges effectifs sauf l'exercice des professions d'avocat et de notaire et les activités que celles-ci leur permettent . - 211 -
Les conseillers sociaux, les juges sociaux et les juges consulaires, à titre effectif ou suppléant, sont soumis aux mêmes règles d'incompatibilité que les juges effectifs, à l'exception : 1 . de celles énoncées à l'article 293, alinéa 2 2 . de l'exercice d'un commerce, l'administration, la direction ou la surveillance de sociétés commerciales et d'établissements industriels ou commerciaux ; 3 . de la conclusion et l'exécution d'un contrat de louage de travail ou d'un contrat d'apprentissage . .
GRIEFS Les griefs du requérant peuvent se résumer comme sui t Les articles 293 et 300 du Code judiciaire créent une incompatibilité entre les fonctions judiciaires, y compris les fonctions non rémunérées de juge suppléant, et l'état ecclésiastique . lls violent l'article 9 de la Convention . puisqu'ils limitent l'exercice de la liberté religieuse et qu'ils ne correspondent à aucun des cas où le deuxième alinéa permet la limitation de l'exercice de cette liberté . Tout en admettant qu'il n'a pas un droit à être nommé juge ou juge suppléant, le requérant estime qu'on ne peut l'écarter ainsi d'une telle fonction sans violer l'article 9 . L'application des articles 293 et 300 du Code judiciaire entraine aussi une violation des articles 9 et 14 de la Convention combinés, en ce qu'elle introduit une discrimination au détriment des seules personnes appartenant à l'état ecclésiastique . Ces dispositions ne visent pas les personnes qui, quoique remplissant des fonctions analogues à celle du requérant, n'appartiennent pas à l'état ecclésiastique . Le requérant estime qu'il est victime d'une violation qui trouve sa source dans la loi elle-même et qui a le caractère d'une violation continue . Les exigences de l'article 26 de la Convention ne lui sont donc pas opposables .
EN DROIT Le requérant se plaint du rejet, par le Ministre de la Justice, de sa candidature à un poste de juge suppléant, au motif que la fonction de juge est incompatible avec l'état ecclésiastique . II voit dans ce rejet une violation de son droit à la liberté de pensée, de conscience et de religion, tel que le lui garantit l'article 9 de la Convention, ainsi qu'une discrimination prohibée par l'article 14 de la Convention .

L'article 9, paragraphe 1, de la Convention stipule : . Toute personne a droit à la liberté de pensée, de conscience et de religion : ce droit implique la liberté de changer de religion ou de conviction, ainsi que la liberté de manifester sa religion ou sa conviction individuellement ou collectivement, en public ou en privé, par le culte, l'enseignement, les pratiques et l'accontplissement des rites . . Quant à l'article 14 de la Convention, il est ainsi conçu : = La jouissance des droits et libertés reconnus dans la présente Convention doit être assurée . sans distinction aucune, fondée notamment sur le sexe, la race, la couleur, la langue, la religion, les opinions politiques ou toutes autres opinions, l'origine nationale ou sociale, l'appartenance à une minorité nationale, la fortune, la naissance ou toute autre situation . . Aux yeux du requérant, l'obstacle mis par la loi belge et par le Ministre de la Juslice à son accès aux fonctions de juge suppléant revient à restreindre indûment et de manière discriminatoire l'exercice de son droit à la liberté de pensée, de conscience et de religion . Pareil raisonnement nécessiterait, au préalable . l'examen du point de savoir si l'article 9 de la Convention garantit à toute personne, non seulement la liberté de professer une foi et de manifester une religion en tant que fidèle, mais aussi celle revêtir une dignité particulière - telle celle de prêtre - dans cette religion .
La Commission estime toutefois que cette question ne se pose pas en l'espèce . En effet, le requérant n'a pas allégué qu'il avait subi des entraves dans la pralique de la religion catholique - y compris l'accès au sacerdoce et, en particulier, n'a pas cherché à montrer comment la pratique de cette religion aurait pu dépendre, de quelque manière que ce soit, de l'accueil de sa candidature aux fonctions de juge suppléant . De l'avis de la Commission, la seule liberté dont l'exercice par le requérant se trouve restreint par les dispositions incriminées est celle de se porter candidat à un poste dans la magistrature judiciaire . Or, la Commission a déjà constalé à plusieurs reprises que la Convenlion ne garantit aucun droit à occuper un poste dans la fonction publique (cf . p . ex . N° 787/60, Rec . 7, p . 75, 79 ; N° 3788/68. Rec . 35, p . 56 . 71) . Elle constate ici qu'à fortiori la Convention ne garantit pas non plus un droit à se porter candidat à un poste dans la magistrature . Le requérant invoque égalentent l'article 14 de la Convention . La Commission souligne à cet égard que le fait que cette disposition vise notamment les distinctions fondées sur . la religion . ou . toute autre situation e n'a nullement pour effet d'attirer dans le champ d'application de la Convention, et notamment de son article 9, toute distinction dictée par des motif s

touchant à la religion . Ainsi que la Commission et la Cour européennes des Droits de l'Homme l'ont maintes fois relevé, l'a rt icle 14 ne prohibe que les discrimination dans la jouissance des droits et libertés qui sont, par ailleurs, reconnus dans la Convention ( cf . p . ex . N° 4505/70, Rec. 39, p . 51, 57 ; N° 7565/76. D .R . 9 . p . 117 . 120 : Cour eur . D .H ., Affaire Syndicat National de la Police belge, arrêt du 27 octobre 1975, paragraphe 44) . En l'espèce, la distinction dont se plaint le requérant po rte sur la liberté de se porter candidat à un poste dans la magistrature judiciaire, libe rt é que la Convention ne protège pas, ainsi qu'il a été dit plus haut . L'a rt icle 14 de la Convention n'entre donc pas en ligne de compte dans la présente affaire . Il s'ensuit que la requête est incompatible ratione materi ae avec les dispositions de la Convention, au sens de son article 27, paragraphe 2 . Par ces motifs, la Comniissio n
DÈCLARE LA REQUÈTE IRRECEVABLE .
(TRANSLATION) THE FACTS The facts of the case as submitted by the applicant may be summarised as follows : The applicant, a Belgian national born on 18 July 1935, is a lawyer practising at the Ghent Bar and a secular priest of the Catholic Church . He is living in Ghent . On 6 July 1959 he obtained a law degree at the State University of Ghent . On 1 September 1959 he took the barrister's oath and was admitted as a trainee barrister . On 16 September 1963 he was entered on the register of the Ghent Bar . On 6 July 1968 he was ordained a priest of the Catholic Church . He has never carried out pastoral duties . He is however sti6 a practising lawyer . In July 1969 he obtained a doctorate in canon law and a degree in labour law . In September 1969 he was appointed as a lecturer in the Catholic University of Louvain .

On 30 March 1978 he applied for a vacant post of substitute judge in the Ghent Court of First Instance . On 31 July 1978 the Minister of Justice informed him that in view of the provisions of Articles 293 and 300 of the Judicial Code he could not recommend him for this post . The applicant satisfied all the requirements of the Judicial Code for holding the office of substitute judge except those stipulated by Articles 293 and 300, which provide that the holding of judicial office is incompatible, inter alia, with an ecclesiastical status . Articles 293 and 300 appear under Chapter 11 (Incompatibilities), pa rt I (Plurality of offices) of the Judicial Code . They provide as follows :
(Translation ) Artlcle 293 - "Judicial office is incompatible with the exercise of a public mandate conferred through election, with any remunerated public office of a political or administrative nature with the offices of nota ry or bailiff, with the profession of barrister, and with milita ry and ecclesiastical status . Judicial office in a labour cou rt is also incompatible with any office in a wager-earners, self-employed workers or employers organisation or in an institution concerned with the enforcement of social secu rity legislation .
The rule stated in paragraph 2 shall not apply to offices held in organisations mentioned therein where such organisations are concemed exclusively with the interests of persons carrying out judicial functions . "
Article 300 -"Substitute judges shall be subject to the same incompatibility rules as are regular judges except in respect of the professions of barrister and notary and the activities which those professions entitle them to carry out. Regular and substitute judges of the labour .,côûft"s%,of; p pealand first instance and of commercial cou rt s shall be subject;to thësamé,üisabilities . as ordina ry regular judges, with the following exceptio~ ~ I . those provided for in Article 293 (2) ;

. the exercise of a trade, the administration, management -2 or supervision of commercial companies and indust ri al or commercial establishments ; . the forntation and execution of labour-hiri ng or apprenticeship 3 contracts ."

COMPLAINTS The applicant's complaints may be summa rised as follows : Articles 293 and 300 of the Judicial Code provide that judicial office, including the unremunerated office of substitute judge, is incompatible with ecclesiastical status . They violate Article 9 of the Convention because they restrict the exercise of freedom of religion and correspond to none of the cases in which the second paragraph allows the exercise of that freedom to be limited . The applicant, while recognising that he does not have a right to be appointed a judge or a substitute judge, considers that denying him access to such an office constitutes a violation of Article 9 .
The application of Articles 293 and 300 of the Judicial Code also entails a violation of Articles 9 and 14 of the Convention taken together, in that it discriminates against persons solely on the ground of their ecclesiastical status . The provisions do not apply to persons who exercise functions similar to the applicant's, but do not have ecclesiastical status . The applicant considers that he is the victim of a violation of a permanent nature originating in the law itself . The requirements of Article 26 of the . Convention may not, therefore be relied upon against him .
THE LA W The applicant complains that the Minister of Justice rejected his application for the post of substitute judge on the ground that the office of judge is incompatible with ecclesiastical status . He regards this rejection as a violation of his right to freedom of thought, conscience and religion guaranteed by Article 9 of the Convention, and as a form of discrimination prohibited by Article 14 of the Convention . Article 9 (1) of the Convention provides that : "Eve ry one has the right to freedom of thought, conscience and religion this right includes freedom to change his religion or belief and freedom, either alone or in communi ty with others and in public or p ri vate, to manifest his religion or belief, in worship, teaching, practice and obse rv ance . " Article 14 of the Convention provides that : "The enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status ."

The applicant considers that the obstacle placed in his way by Belgian law and by the Minister of Justice, preventing access to the office of substitute judge, amounts to an excessive and discriminatory restriction of the exercise of his right to freedom of thought, conscience and religion . Such a line of argument would require, first of all, an examination of whether Article 9 of the Convention guaranteed to everyone the freedom not only to profess a faith and manifest a religion as a believer therein, but also to hold a specific office-such as that of priest-in that religion . The Commission considers, however, that this question does not arise in the instant case . The applicant has not alleged that he was impeded in the practice of the Catholic religion-including access to the priesthood-and, in particular, has not attempted to show how the practice of that religion could have depended, in any way whatever, on the acceptance of his application for the position of substitute judge . The Commission considcrs that the only frccdoni whose cxerci .sc by the applicant is restricted by the provisions complained of is the freedom to apply for a position in the judiciary . However, the Commission has held on several occasions that the Convention does not guarantee any right to hold an office in the public service (cf. e .g . No . 787/60, Coll . 7, pp . 75, 79 ; No . 3799/68 . Coll . 35, pp . 56, 71) . It finds here that a fortiori the Convention does not guarantee a right to apply for a position in the judiciary either . The applicant also invokes Article 14 of the Convention . In this regard the Commission emphasises that the fact that that provision mentions irtter alia discrimination based on "religion" or "other status" in no way brings any distinction based on grounds connected with religion within the scope of the Convention, or, in particular, of Article 9 thereof . As the European Commission and Court of Human Rights have held several times, Article 14 prohibits only discrimination in the enjoyment of those rights and freedoms recognised in the Convention (cf. e .g . No . 4505/70, Coll . 39, pp . 51, 57 ; No . 7565/76, D .R . 9, pp . 117, 120 ; Eur . Court H .R ., Case of the "Syndicat National de la Police belgé", judgment of 27 October 1975, para . 44) . In the instant case, the discrimination complained of by the applicant relates to the freedom to apply for a position in the judiciary, a freedom which, as already stated, the Convention does not protect . Consequently, Article 14 of the Convention is nof relevant to the instant case . It follows that the application is incompatible ratiorre materiae with the provisions of the Convention within the meaning of Article 27, paragraph 2 . For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBLE .
