Article 6, paragraph 3 (e) of the Convention : The Convention does not entitle the accused to require his lawyer to adopt a particular defence strategy which the latter regards as impossible to maintain, especially if the accused is given the opportunity ro address to court himself.

Résumé des faits pertinents
Accusé de crime manqué d'assassinat, séquestration, viol et attentat à la pudeur des enfants avec circonstances aggravantes, le requérant fut mis au bénéfrce de l'assistance judiciaire et pourvu d'un avocat d'office. Avant l'audience de jugement, le requérant déclara révoquer cet avocat et désigner un défenseur de son chôix, un avocat stagiaire . Le président du Tribunal, n'ayant pas reçu avis d'acceptation du mandat par ce défenseur, désigna un nouvel avocat d'office. Le requérant s'en plaignit et déclara qu'il était en désaccord avec ce nouvel avocat d'office sur la manière de présenter sa défense . Il demanda au président de révoquer son mandat et de désigner à sa place le défenseur qu'il avait lui-méme choisi . Le président refusa . Après avoir été défendu par le second avocat nommé d'office par le président, le requérant fut condamné à/a réclusion à vie.

Par la voie d'un pourvoi devant la cour de cassation cantonale, puis d'un recours en nullité et d'un recours de droit public au Tribunal fédéral. le requérant s'est p[ain[ de son avocat d'office, en particulier de ce que celui-ci ait refusé de plaider la thèse de l'innocence, considérée par cet avocat comme insoutenable .
EN DROIT (Extrait) Le requérant estime qu'il y a eu violation de la Convention du fait que l'avocat d'office a plaidé brièvement lors de l'audience de jugement et n'a pas soutenu la thèse de l'innocence . En revanche, la cour de cassation pénale du tribunal cantonal du Canton de Vaud . quant à elle, a estimé que les conclusions prises par l'avocat d'office étaient pertinentes . Il n'appartient pas à la Commission de se prononcer sur les thèses qui, en l'espèce, devaient être avancées pour que la défense soit convenablement assurée . La Commission constate par contre que le requérant a été, en fait . assisté d'un avocat lors de son procès . Elle estime en outre que la Convention ne confère pas à l'accusé le droit d'imposer à son avocat un système de défense que celui-ci juge insoutenable, surtout si l'occasion est fournie à l'accusé de s'adresser lui-même au tribunal . Il est au demeurant important de souligner à ce sujet que le requérant, ayant eu la parole en dernier lieu, a déclaré n'avoir rien à ajouter pour sa défense . Enfin, la Commission prend en considération le fait que le requérant a pu contester la procédure de première instance devant la juridiction de recours cantonale et ensuite fédérale, par le truchement de deux avocats qui lui furent désignés d'office et dont il loua le dévouement . Au vu de l'ensemble de ces circonstances, la Commission estime qu'il n'y a pas apparence de violation de la Convention, en particulier de ses articles 6, paragraphe 1 ou 6, paragraphe 3 (c) et que la requête est manifestement mal fondée, au sens de l'article 27, paragraphe 2 .

Summary of the relevant fact s Charged with attempted rnurder, unlawful detention, rape and indecent assault on clrildren . with aggravating circumstances, the applicant was granted legal aid and the services of a lawyer appointed by the court . Before the court hearing, the applicant expressly dismissed this lawyer and appointed a trainee lawyer of his own choosing as defense counsel. The presiding judge, not having received notice of this lawver's acceptance of iustructioris, appointed a new lawyer. The applicant complained, stating that he was in disagreement with the wav in which this new lawyer appointed bv the court was presenting his defence. Ne asked the presidingjudge to terminate instructions and appoint in his place the defence counsel that he had himself chosen . The presiding jndge refused. After being defended by the secortd lawyer appointed bv the presiding judge, the applicant was sentenced to life imprisonntent .
By lodging an appeal with the Cantonal Court of Cassation, followed kv an appeal against conviction and sentence and a public law appeal to the Federal Court, the applicant complained of the lawyer appointed kv the Court stating in particular that the latter had refused to defend his plea of innocence which he had regarded as impossible to uphold.
(TRANSLATION) THE LAW (Extract) The applicant considers that the Convention was violated in so far as the lawyer appointed by the court pleaded b ri efly du ri ng the heari ng and did not present his plea of innocence . On the other hand, the Criminal Court of Cassation attached to the Vaud Cantonal Court considered that the conclusions drawn by the lawyer appointed by the presiding judge were pe rtinent . It is not for the Commission to give a ruling conceming the arguments that, in this case, had to be adduced so that the defence could be properly conducted . The Commission notes on the other hand that the applicant was in fact assisted by a lawyer during his hearing . It further notes that the Convention does not entitle the accused to require his lawyer to adopt a particular defence strategy which the latter regards as impossible to maintain especially if the accused is given the opportunity to address the court himself . What has to be emphasised here is that the applicant, on being invited to make a final statement, said that he had nothing to add in his defence .

Lastly, the Commission must take account of the fact that the applicant was able to contest the first instance proceedings before the Cantonal and Federal Appeal Courts, through the intermedia ry of two lawyers appointed to conduct his defence, whose dedication he commended . The Commission considers that all these circumstances taken together do not disclose any appearance of a violation of the Convention, in particular Article 6, paragraph I and Article 6, paragraph 3(c), and that the application is manifestly ill - founded within the meaning of Article 27, paragraph 2 .
