Summary of the facts

The applicant, a Pakistan citizen, runs a carpet business and resided in Sweden when lodging h!s application . When he considered a bank in Gothenborg with whom he did business had nor respected its unde rtaking, he instituted court proceedings against it before the District Court in Gothenborg . The defendant bank requested that the applicant be ordered by the courr to provide security for costs and damages, on the basis of Article 1 of an Act of 1886. This Act provides that an afien, whether or not he lives in Sweden, can be ordered to furnish a security, in order to be able to institute

proceedings before a Swedish court . Such a security is intended to cover legal costs and damages for which he might be fiabfe in respect of the defendant . In default of payment of this security within the legal time-fimit, the action was rejected. The applicant declared himself unable to furnish the security in view of the losses he had just incurred . The court nevertheless ordered that the applicant produce a security of 50, 00 7 Swedish crowns within two and a haK months. Ten days later the defendant bank withdrew its request for a security and the court revoked its order . Shortly afterwards, the parties came to an agreement .
The Respondent Government informed the Commission that it intended to modify or abrogate the 1886 Act .
THE LAW 1 . The applicant has alleged a violation of Articles 6 and 14 of the Convention by reason of the decision of the Gothenborg District Court that he should provide a security of 50,000 Swedish crowns at the risk of otherwise having his court action dismissed . The applicant considers that the Act of 1886, on which the decision was based, is discriminatory and that it prevents him from bringing also other claims before Swedish courts since he cannot afford to provide any security . 2 . It is true that the right of access to court constitutes an element which is inherent in the right stated by Article 6 .1 of the Convention (cf . European Court of Human Rights, Judgment of 7 May 1974 in the "Golder" Case, Series A, Vol . 18, para . 36) . Article 14 furthermore, prohibits discrimination in the enjoyment of the rights and freedoms set forth in the Convention "on any ground such as . . . national or social origin . . . or other status" . 3 . The question that arises in the present case is thus whether the Act of 1886, and its application to the applicant, may have impeded his launching the court actions contemplated by him in a manner that could be considered to be at variance with Article 6 .1 of the Convention taken either alone or in conjunction with Article 14 . 4 . It is in the first place beyond dispute that, as regards the court action brought against the Y . Bank, the defendant withdrew its demand for security . As a consequence of this withdrawal, the District Court revoked on 3 May 1977 its earlier decision of 22 April 1977 by which the applicant had been ordered to furnish the security . Therefore, as from 3 May 1977, there were no longer any formal obstacles to the applicant's proceeding with hi s

civil court action against the Bank . However, for reasons unknown to the Commission, the applicant did not pursue his claim before the District Court but resolved instead to make an agreement with the defendant Bank which resulted in a formal dismissal of the court action by decision given on 18 July 1977 . 5 . In view of these facts, the Commission is satisfied that the applicant has not been denied access to the courts for the purpose of bringing a civil claim against the Bank in a .manner contrary to Article 6 .1 of the Convention taken either alone or in conjunction with Article 14 . The mere fact that the applicant was during eleven days in principle under an obligation to provide the security is not, in itself, conclusive for the question as to whether he was refused access to the courts within the meaning of these provisions of the Convention . 6 . The Commission understands that the applicant considers that the mere existence of the 1886 Act prevents him from proceeding with other claims before Swedish courts . 7 . However, the Commission does not share this view . It notes in particular in this respect that the Swedish courts do not have to apply the Act of 1886 ex ollicio but only at the request of the defendant party . The defendant may on the other hand not make use of the right provided by the Act of 1886 and, if so, the foreign plaintiff can proceed with his action in the normal way . Furthermore, it cannot be assumed that a request for security would automatically prevent a foreign plaintiff from access to the courts, since he might have sufficient means for providing the security . In other words, it would appear to depend on an examination of the application of the 1886 Act in a concrete case as to whether or not a demand for security could be considered to amount to a denial of access to the courts contrary to the provisions of the Convention . The Commission notes moreover in this context that the applicant has not submitted any evidence to show that, on any other occasions than that dealt with above, he has been ordered to provide security to the effect that he has been unable to pursue civil claims before Swedish courts . 8 . It is true,on the othér hand, that the terms of the 1886 Act appear to be more severe than similar laws existing in some other European countries . If invoked, it applies for instance irrespective of whethérthe foreign plaintiff is resident in Sweden and without regard to the possibility of his being in possession of pioperty within the country which could cover the costs that might be imposed on him . The Commission notes with satisfaction in this respect, however, that the Swedish authorities envisage to change the legislation on the matter of cautio judicatum solvi.

9 . In view of the preceding considerations, an examination by the Commission of this case, as it has been submitted,, including an examination made ex officio, does not disclose any appearance of a violation of the rights and freedoms set out in the Convention and in particular in Articles 6 .1 and 14 thereof . 10 . It follows that the application is manifestly ill-founded within the meaning of Article 27 .2 of the Convention .
For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBLE .
Résumé des faits Le requérant, citoyen pakistanais, fait le commerce de tapis et séjournait en Suéde au moment de l'introduction de sa requête . Estimant qu'une banque de G6teborg, avec qui il était en relations d'affaires, n'avait pas rempli ses obligations à son égard, il intenta action contre elle devant le tribunaf de cette ville . Se fondant sur l'article 1 d'une loi de 1886, la banque défenderesse requit le tribunal d'ordonner le versement de sOretés par le requérant . Cette loi stipulait qu'un étranger, résidant ou non en Suéde, pouvait être astreint 8 verser des sOretés pour pouvoir intenter action devant un tribunal suédois, ces sûretés devant couvrir les frais de justice et les dommages-intéréts auxquels il pouvait être condamné envers le défendeur. A défaut du versement des sOretés dans le délai fixé, l'action était rejetée . Le requérant se déclara incapable de fournir des sûretés vu les pertes qu'il venait de subir . Le tribunal ordonna néanmoins le dépôt de 50 L0 7 couronnes dans le délai de deux mois et demi .
Dix jours plus tard, la banque défenderesse retira sa demande de sûretés et le tribunal révoqua son ordonnance . Peu après, les parties parvinrent à une transaction (et le requérant laissa rendre jugement contre lutl . Le Gouvernement défendeur a fait savoir B la Commission qu'il était envtsagé de modifier ou d'abroger la loi de 1886.

(TRADUCTION) EN DROI T 1 . Le requérant allégue que la décision du tribunal de district de Gôteborg, lui imposant de fournir une caution de 50 000 Couronnes suédoises sous peine de rejet de son action en justice, constitue une violation des articles 6 et 14 de la Convention . II considére que la loi de 1886, sur laquelle la décision se fondait, est discriminatoire et qu'elle l'empeche d'intenter aussi d'autres actions devant les tribunaux suédois, puisqu'il n'a les moyens de fournir aucune caution . 2 . II est vrai que le droit d'accés aux tribunaux constitue un élément inhérent au droit énoncé à l'article 6, paragraphe 1 de la Convention (cf . Cour européenne des Droits de l'Homme, Arrêt du 7 mai 1974 dans l'affaire « Golder », Série A, Vol . 18, p . 18, par . 36) . L'article 14, en outre, interdit toute discrimination dans la jouissance des droits et libertés reconnus dans la Convention « fondée notamment sur . . . l'origine nationale ou sociale . . . ou toute autre situation » . 3 . La question qui se pose en l'occurrence est donc de savoir si la loi de 1886 et l'application qui en a été faite au requérant, peut avoir emp2ché celui-ci d'ouvrir devant les tribunaux les actions qu'il avait l'intention d'intenter et cela d'une manière pouvant être considérée comme incompatible avec l'article 6, paragraphe 1, de la Convention pris soit isolément, soit en conjonction avec l'article 14 . En premier lieu, il n'est oas contesté qu'en ce qui concerne l'actio n .4 dirigée contre la Banque Y ., celle-ci retira sa demande de caution . Par suite de ce retrait, le tribunal de district raoporta le . 3 mai 1977 sa décision du 22 avril 1977 par laquelle il avait ordonné au requérant de foûrnir la caution . C'est pourquoi, à partir du 3 mai 1977, rién né s'opposait plus, du point de vue formel, à ce que le requérant intente action civile contre la banque . Toutefois, pour des raisons inconnues de la Commission, le requérant ne poursuivit pas son action devant le tribunal de district, mais décida de conclure un arrangement avec la banque défenderesse, arrangement qui se traduisit formellement par une décision du tribunal rejetant la demande le 18 juillet 1977 . ' 5 . Compte tenu de ces faits, la Commission est d'avis que le requérant ne s'est pas vu refuser l'accés aux tribunaux d'une manière qui serait incompatible avec l'article 6, paragraphe 1 de la Convention, pris isolément ou conjointement avec l'article 14, en vue d'intenter une action civile contre la banque . Le simple fait que le requérant se soit trouvé pendant onze jours, en principe, dans l'obligation de fournir caution, n'est pas déterminant quant au point de savoir si l'accès des tribunaux lui a été retusé au sens des dispositions de la Convention .

6 . La Commission croit comprendre que, de l'avis du requérant, la simple existence de la loi de 1886 l'emp®che d'ouvrir d'autres actions devant les tribunaux suédois . 7 . La Commission ne partage pas cet avis . Elle note, en pa rticulier, à cet égard, que les tribunaux suédois n'ont pas à appliquer la loi de 1886 d'office, mais seulement é la demande de la partie défenderesse . Mais le défendeur peut ne pas faire usage du droit inscrit dans la loi de 1886 et, dans ce cas, le demandeur étranger peut introduire action normalement . En outre, on ne . peut considérer qu'une demande de caution empêchera automatiquement un demandeur étranger d'avoir accés aux tribunaux, celui-ci pouvant en effet disposer de ressources suffisantespour fournir la caution . En d'autres termes, il apparaît qu'il faille examiner l'application de la loi de 1886 dans chaque cas concret pour déterminer si l'exigence d'une caution peut aboutic à refuser au demandeur d'une maniére incompatible avec les dispositions de la Convention, l'accés aux tribunaux . La Commission note en outre dans ce contexte que le requérant n'a fourni aucun élément de preuve montrant qu'é d'autres occasions, l'exigence d'avoir à fournir une caution l'aurait empéché d'engager une procédure civile devant les tribunaux suédois . 8 . II est vrai, d'autre part, que les dispositions de la loi de 1886 semblent plus sévéres que celles de lois analogues existant dans ce rtains autres pays européens . Si elle est invoquée, elle s'applique, par exemple, indépendamment de la question de savoir si le requérant étranger réside en Suède et sans considération du point de savoir s'il posséde dans le pays des biens suffisants pour couvrir les frais qu'il pourrait avoir à payer. La Commission note toutefois avec satisfaction, à cet égard, que les autorités suédoises envisagent de modifier la législation sur la question de la cautio judicatum solvi . 9 . Compte tenu des considérations qui précèdent, l'examen de cette affaire par la Commission, telle qu'elle a été présentée, y compris un examen d'office, ne révéle aucune apparance de violation des droits et libertés défini s dans la Convention, et en particulier dans ses articles 6, paragraphe 1, et 14 .
10 . II s'ensuit que la requête est manifestement mal fondée au sens d e l'article 27, paragraphe 2, de la Convention . Par ces motifs, la Commission DECLARE LA REOUETE IRRECEVABLE .
