Summa ry of the relevant facts I francais : voir p . 254 1 The applicant, a doctor in Austria, was the victim of a mountain accident in Switzerland with a group of other people, going to the assistance of another climber in very serious difficulry . Under Article 176, paragraph 1 (2) of the Austrian General Social Insurance Act (Allgemeine Sozialversicherungsgesetzl a pe rson having been the victim of an accident while attempting to rescue another pe rs on from danger of death has a right to such a.pension as he would have received had the injury sustained been the result of an industrial accident.

Afflicted by permanent parrial invalidity, the applicant was granted a pension by the Court of Arbitration for Social Insurance (Schiedsgericht der SoziaNersicherungl . This decision was reversed by the Court of Appeal of Vienna on the ground that the accident had taken place outside Austrian territory. The applicant complains, in particular, that the Courr of Appeal dealt with the case in camera . He also alleges that under Artic% 91 (1), of the Austrian Constitution, the Court should have included a lay element ; for lack of which the Court should be considered as a court of exceptional jurisdiction . THE LAW (Extract) .. .. ... .. .. .. . The applicant has (also) complained of the proceedings before the Vienna Court of Appeal . He alleges a violation of Article 6 of the Convention in that the decision of this Court was taken without any participation of the people and, moreover, behind closed doors . It is true that Article 6 (1) of the Convention provides that "in the determination of his civil rights and obligations . . . everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law . . ." . The tirst question to be decided by the Commission is whether the court proceedings relating to the applicant's claim for an invalidity pension fall within the scope of this provision in that they involved the determination of his civil rights . In this connection the Commission 'recalls that it has repeatedly held that it is not decisive whether the right claimed by the applicant constitutes a "civil right" in the country concerned and that the term "civil rights and obligations" cannot be construed as a mere reference to the domestic law of the High Contracting Party concerned . Instead, the concept relates to an autonomous notion which must be interpreted independently having regard to the nature of the claim and to the purpose of the complaint . Only in this connection can the general principles of the domestic law of the High Contracting Parties be taken into consideration (cf . e .g . decision on the admissibility of Application No . 4505/70, X . v . the Federal Republic of Germany, Collection of Decisions 39, p . 51 at p . 56) .
In the present case the applicant claimed an invalidity pension under the Austrian legislation which provides such pension for a person who has been the victim of an accident when attempting to rescue another person from a danger to life . The Commission understands that these pensions are granted by the State in the execution of its aim to take care of the individual well-being of its citizens in certain circumstances . Consequently, a claim such as that of the present applicant does not involve a right of a privat e

character . In these circumstances the Commission concludes that the proceedings before the Vienna Court of Appeal were not concerned with the determination of the applicant's "civil rightsand obligations" and thatthey therefore fall outside the scope of Article 6 of the Convention . It follows that the Commission has no competence 2tione materiae to examine this part of the application which must therefore be rejected as being incompatible .with the provisions of the Convention in accordance with . . , . ~ Article 27 (2) thereof .
Résumé des faits pertinents Le requérant, médecin en Autriche, a étévictime en Suisse d'un accident de montagne alors qu'il faisait pan'ie,d'un groupe de personnes a//ant au secours d'autres alpinistes, qui se tmuvaient en détresse . Selon l'an'ic/e 176, paragraphe 1, chapitre 2, de la loi générale autrichténne sur les assurances socia/es IAllgemeines Sozialversicherungsgesetzl, l'accident subi par une personne qui se porte au secours d'une autre personne en danger de mort est indemnisé comme un accident du travail s'est vu .Ateind'uvalépneoctrôyer une t,rqua
pension par le tribunal arbitral dés assurances sociales (Schiedsgericht der Sozialvetsicherung) . Cette décision a été annulée par la cour d'appel de Vienne au motif que l'accident avait eu lieu hors du territoire autrichien . (TRADUCTION) EN DROIT ( Extrait ) . .. .. .. .. .... . Le requérant se plaint légalementl du déroulement de la procédur e devant la dour d'appel de Viénne . Il allégue une violation de l'article 6 de la Convention en ce que la cour a pris sa décision sans représentatioh populaire et, de plus, à huis clos . II est vrai que l'article-6, paragraphe 1, de la Convention stipule qu e aToute personne a droit à ce que-sa cause soit entendue équitablement, publiquement et dans un délai raisonnable, par un tribunal indépendant e t

impartial, établi par la loi . . . » . La premiére question que doit trancher la Commission est celle de savoir si la procédure judiciaire concernant la demande d'une pension d'invalidité par le requérant reléve de cette disposition, comme comportant décision sur une contestation portant sur des droits civils de l'intéressé . A cet égard, la Commission rappelle avoir déclaré à plusieurs reprises que le point de savoir si le droit revendiqué par le requérant constitue un « droit de caractére civil » dans le pays concerné n'est pas un élément décisif et que l'expression « droits et obligations de caractére civil » ne saurait s'interpréter comme une simple référence au droit interne de laPartié Contractante mise en cause . Il s'agit plutôt d'une notion autonome qu'il faut interpréter indépendamment, compte tenu de la nature et de l'objet de la plainte . C'est dans ces limites seulement que les principes généraux du droit interne des Parties Contractantes peuvent être pris en considération (voir par exemple la décision sur la recevabilité de la requéte N° 4505/70, X . c/République Fédérale d'Allemagne, Recueil de Décisions 39, pp . 51-56) . En l'espéce, le requérant réclamait une pension d'invalidité conformément à la législation autrichienne, qui prévoit l'allocation de ce genre de pension à la personne victime d'un accident alors qu'elle essayait de porter secours à une personne en danger de mort . La Commission admet que l'Etat accorde de telles pensions en ayant pour but de veiller au bien-être individuel de ses ressortissants dans certaines circonstances . En conséquence, une revendication comme celle que présente le requérant ne porte pas sur un droit de caractère privé . Dans ces conditions, la Commission en conclut que la procédure qui s'est déroulée devant la cour d'appel de Vienne ne comportait pas une décision sur une contestation portant sur des « droits et obligations de caractére civil » du requérant et qu'elle échappe en conséquence à l'article 6 de la Convention . Il s'ensuit que la Commission n'a pas compétence ratione materiae pour examiner cette partie de la requête et que celle-ci doit donc, conformément à l'article 27, paragraphe 2, être rejetée comme incompatible avec les dispositions de la Convention .
