Article 9 of the Convention : /n cases where a religion requires its adherents to wear a turban, the compulsory wearing of crash helmets can be considered justified under the terms of Article 9 (2) . This justification continues to exist even though the law subsequently granted an exemption on religious grounds.

The applicant, an Indian citizen, lives in the United Kingdom . The applicant, a sikh, ls required by his religion to wear a turban . Between 1973 and 1976, he was prosecuted, convicted and fined twenty times for failing to wear a crash helmet when riding his motor cycle. He complains that the requirement to wear a crash helmet, whic h obliges him to remove hfs turban, whilst riding his motor cycle interferes with his freedom of religion : At rhe end of 1976 an amendment to rhe legislation exempted sikhs from wearing crash helmets.

THE LA W The applicant complains that the Motor Cycle IWearing of Helmets) Regulations 1973 violated his right to freedom of religion by penalising him for failing to remove his turban and put on a crash helmet when riding his motor cycle . Article 9 of the Convention provides tha t "1 . Everyone has the right to freedom of thought, conscience and religion ; this right includes freedom to change his religion or belief and freedom, either alone or in community with others and in public or in privale, to manifest his religion or belief, in worship, teaching, practice and observance . 2 . Freedom to manifest one's religion or beliefs shall be subject only to such limitations as are prescribed by law and are necessary in a democratic society in the interests of public safety, for the protection of public order, health or morals, or for the protection of the rights and freedoms of others" . The Commission considers that the compulsory wearing of crash helmets is a necessary safety measure for motor cyclists . The Commission is of the opinion therefore that any interference that there may have been with the applicant's freedom of religion was justified for the protection of health in Accordance with Article 9 121 . The facts that Sikhs were later granted an exemption to the traffi c regulations does not in the Commission's opinion vitiate the valid health considerations on which the regulations are based . The Commission concludes therefore that the penalisation of the applicant for failing to comply with these regulations did not constitute a violation of Article 9 of the Convention . EN DROI T Le requérant se plaint que la loi dite Motor Cycle (Wearing of helmets) Regulations 1973 viole son droit à sa liberté de relition dans la mesure où elle lui impose une sanction pour avoir omis de retirer son turban et porter un casque de protection en circulant sur un motocycle .
L'article 9 de la Convention stipule : « 1 . Toute personne a droit à la liberté de pensée, de conscience et de religion ; ce droit implique la liberté de changer de relition ou de conviction, ainsi que la liberté de manifester sa religion ou sa conviction individuellement oucollectivement, en public ou en privé, par le culte, l'enseignement, les pratiques et l'accomplissement des rites .
2 . La liberté de manifester sa religion ou ses convictions ne peut faire l'objet d'autres restrictions que celles qui, prévues par la loi, constituent des mesures nécessaires, dans une société démocfatique, à la sécurité publique, à la protection de l'ordre, de la santé ou de la morale publiques, ou à la protection des droits et libertés d'autrui .La Commission estime que le port obligatoire d'un casque de protection est une mesure de sécurité nécessaire pour les motocyclistes . d'avis que toute ingerence que le requérant pourrait avoir subie de ce fait dans l'exercice de son droit à la liberté de religion est justifiée pour la protection de la santé, en vertu de l'article 9, par . 2 . Le fait qu'une exception aux régles de circulation a été conséntie par la suite en faveur des sikhs n'enléve pas, de l'avis de la Commission, les considérations relatives à la santé sur lesquelles se fonde la réglementation . La Commission en conclut que les sanctions infligées au requérant pour avoir omis de se conformer à cette réglementation ne constituent pas une violation de l'article 9 de la Convention . Il s'ensuit que la requête est manifestement mal fondée, au sens de l'article 27, par . 2, de la Convention .
Par ces motifs, la Commission DECLARELA REQUETEIRRECEVABLE .
