Condamné é dix ans de réclusion criminelle par une cour d'assises française, le requérant, citoyen français, a été libéré conditionnellement en février 1973 et s'est rendu en Belgique peu aprés . En juin 1973, il fut arrêté à Bruxelles, inculpé de vol et de recef, puis mis en liberté . En octobre 1973, il fut arrêté à nouveau en Belgique et inculpé de faux, usage de faux, port public de faux nom et séjour illégat . La police saisit dans un coffre auquel il avait accés diverses devises à concurrence de 220 007 francs belges. En avril 1974, les autorités françaises demendérent t'extradition du requérant pour purger le solde de sa peine, la mesure de libération conditionnelle ayant été révoquée . Elles formulérent peu aprés une deuxiéme demande d'extradition pour vol de voiture.

Le 18 septembre 1974, la chambre du conseil belge décida qu'il pouvait être mis fin A la détention provisoire du requérant . Néanmoins celui-ci demeura incarcéré en vue d'extradition . La chambre des mises en accusation rendit un avis favorable à l'extradition le 3 juin 1974 et le 29 octobre 1974, respectivement . En janvier 1975 le requérant fut condamné en Belgique é trois ans de prrson et à diverses indemnités aux parties civiles . En mars 1975, le Gouvernement belge accorda l'extradition du requérant A la France mais ajourna sa remise pour qu'il puisse purger une partie de la peine prononcée en Belgique . En tévrier 1975, le parquet belge a ordonné la restitution au requérant des sommes saisies par la police, mais les parties civiles obtinrent une saisie-arrét conservatoire et introduisirent ensuite action en paiement . Le requérant a été remis aux autorités françaises en janvier 1976. Devant la Commission, le requérant a atlégué :
- Qu'aprés l'avis favorable de la chambre des mises en accusation, le mintstre be/ge compétent ne disposait, en droit belge, que de quinze jours pour accorder l'extradition ou la refuser et mettre le requérant en liberté ; celui-ci aurait donc été détenu arbitrairement entre le 14 novembre 1974 et le 24janvier 1975, date de sa condamnation en Belgique . - Que son extradition était irréguliére, le non-respect des conditions mises à une libération conditionnelle n'étant pas un fait donnant lieu à extradition entre la Belgique et la France . - Que les sommes saisies par la police belge auraient d0 lui être restituée et que la durée de la procédure engagée 9 ce sujet par les parties civiles excédait un délai raisonnable .
EN DROI T 1 . Le requérant se plaint d'avoir été maintenu en détention arbitraire après que la chambre du conseil ait rendu un avis favorable à son extradition . Cette détention irréguliére aurait duré deux mois . Il allégue à cet égard la violation de l'article 5, § 1 qui garantit le droit à la liberté et à la sOreté et énumére de façon limitative les cas dans lesquels une personne peut 8tre privée de sa liberté pourvu que soient respectées les voies légales . A dater du 18 septembre 1974 le requérant a, sans aucun doute, été dans la situation d'une « personne contre laquelle une procédure d'extradition est en cours n au sens de l'article 5 . § 1 fl . Deux requétes d'extradition avaient en effet été transmises au Gouvernement belge . Le requérant était détenu en vertu d'un mandat d'arrêt international rendu exécutoire en Belgique . La chambre des mises en accusation avait été saisie par le Gouvernement belge de deux demandes d'avis relatives à l'extradition sur lesquelles elle s'est prononcée favorablement les 3 juin et 29 octobre 1974 . La question de savoir si la détention a été réguliére (lawful) doit s'apprécier essentiellement au regard du droit belge . Or, contrairement à ce qu'allégue le requérant, la loi belge n'impose pas au Ministre de la Justice une obligation de statuer sous quinzaine à dater de la réception de l'avis de la chambre des mises en accusation . L'article 3 de la loi du 15 mars 1874 sur les extraditions dispose en effet exclusivement en matiére de délais que,aussitbt que l'étranger aura été écroué en exécution de l'un des actes ci-dessus mentionnés (lugement de condamnation, manda t

d'arrêt, . .1, le Gouvernement prendra l'avis de la chambre des mises en accusation de la cour d'appel . . . et que dans la quinzaine, à dater de la réception des piéces, elles seront renvoyées, avec l'avis motivé, au Ministre de la Justice n . Il résulte ainsi de l'examen du dossier que le requérant s'est trouvé dans la période litigieuse en détention réguliére conforme à l'article 5, § 1 fl, une procédure d'extradition étant effectivement en cours . Il s'ensuit que le grief est manifestement mal fondé au sens de l'article 27, § 2, de la Convention . 2 . Le requérant fait encore valoir que son extradition a été accordée en violation de la convention franco-belge d'extradition ainsi que de la loi belge du 15 mars 1874 sur les extraditions . Toutefois, le domaine de l'extradition, comme celui de l'expulsion, ne compte pas par lui-môme, au nombre des matières régies par la Convention, en sorte que le grief est incompatible ratione materiae avec les dispositions de la Convention, au sens de l'article 27, § 2, de celle-ci . 3 . Le requérant se plaint enfin de la non-restitution des fonds saisis dans le cadre de l'instruction judiciaire et de la lenteur de la procédure relative aux prosécutions des parties civiles . Les fonds dont le requérant réclame la restitution font, pour une trés large part et aprés déduction des amendes et frais de justice, l'objet d'une saisie-arrét conservatoire entre les mains du greffier en vertu d'une ordonnance du juge des saisies requis par diverses parties civiles . Cette saisie-arrit vaut pendant trois années (article 1458 du code Îudiciaire belge) . Les fonds se trouvent ainsi temporairement bloqués dans le cadre d'un litige civil, en vue de protéger les intéréts de personnes lésées par une infraction . Il ne saurait dés lors btre question d'une atteinte au droit de propriété prohibée par l'article 1 du Protocole additionnel (cf ., mutatis mutandis, Requête N° 5483/72 c/Pays-Bas, Rec . 44 p . 60) .
Quant à la durée de la procédure, envisagée sous l'article 6, § 1, on relévera qu'une année s'est écoulée depuis l'expiration du délai imparti aux parties civiles pour faire valoir leurs droits et depuis la première citation directe effectuée par les parties civiles les plus diligentes . Il semble cependant que le juge ait ajourné l'audience dans cette affaire à l'initiative des parties civiles afin de faciliter le réglement de l'ensemble des créances que celles-ci font valoir . Il ne ressort pas du dossier que le requérant ait demandé une nouvelle fixation en sorte qu'il ne semble pas avoir montré la diligence souhaitée des parties au procés civil . Dans ces circonstances un examen par la Commission des faits, tels qu'ils ont été présentés, ne permet pas de déceler l'apparence d'une violation de la Convention et en particulier de son article 6 . § 1 ou de l'article 1 du Protocole additionnel . Il s'ensuit que la requéte est, à cet égard, manifestement mal fondée au sens de l'article 27, § 2, de la Convention . Par ces motifs, la Commission DECLARE LA REQUÉTE IRRECEVABLE .

Summary of the facts The applicant, a French citizen, sentenced to ten years of imprisonment by a French court of assizes, was released on probation in February 1973. Shortly aftenvards he went to Belgium . ln une 1973 he was arrested in Brussels on charges of theft and receiving stolen goods, but subsequently set free . ln October 1973, he was again arrested in Belgium on charges of forgery, use of forged documents, public use of a false nanre and illegal residence . The police seized from a safe to which he .res anrounting to a total of 220,0 00 Belgian francs . hnd access vurrous currenr ln April 1974, the French authorities requested the extradition of the applicant in order to serve the rernainder of the sentence, the order for conditional release having been revoked in the meantime . Short/y afterwards they lodged a second request for extradition on a charge of stealino a motor vehicle . On 18 September 1974, the Be%qian judges' chamber decided that arn end could be put to the applicant's detention on remand. However, he remained in prrson with a view to his extradition . The cou rt (Chambre des mises en accusation) gave an opinion in favour of his extradition on 3 June 1974 and on 29October 1974 . 1n January 1975, the applicant was sentenced in Belgium to three years of tmpri.sonrrrent and to pay various sums of compensation . ln March 1975 the Belgian Government granted the extradition of the applicant to France, but adjourned his transfer in order to let hinr serve part of the sentence pronounced in Bel,qiunr In February 1975, the Belgian Public Prosecutor's Office ordered the restitution to ttre applicant of the sums seized by the police, but the pnrlies entit/erl tu conrpensation obtained a provisional order for the attachment of the nruney rrnd then rntroduced an action for payment. The applicant was transferred to !he French authorities in antrary 1976. Before the Commission, the applicant alleges : - that after the court (Chambre des mises en accusation) had given an opinion in favour ot h1s extradition, the Belgrân Minister only had 15 days, under Belgian law, to grant rhe extradition or to refuse it and release the apphcant . He had therefore been derained arbitrarily between 14 Novenrber 1974 and 24 anuary 1975, date of his conviction in Belgium ; - that his extradition was unlawful since the failure to respect the conditions for a conditional release was not a ground for extradition between Belgium and France ; - that the sunrs seized by the Belgian police ought to have been returned to him an d that the length of the civil proceedings instituted for that purpose exceed a reasonable tinre .

I TRANSL ATIONI THE LA W 1 . The applicant complains of being arbitrarily detained after the judge's chamber had advised in favour of his extradition . This unlawful detention is claimed to have lasted two months . He alleges in this respect a violation of Art . 5, para . 1, which guarantees the right to freedom and security of person and contains an exhaustive list of circumstances in which a person may be deprived of his liberty in accordance with a procedure prescribed by law . As from 18 December 1974 the applicant was undoubtedly in the situation of "a person against whom action is being taken with a view to deportation or extradition", as referred to in Art . 5 (1) (f), since two applications for extradition had been transmitted to the Belgian Government . The applicant was being detained under an international arrest warrant enforceable in Belgium . The court (Chambre des mises en accusation) had received from the Belgian Government two requests for opinions on extradition and, as a result, had given an opinion in favour of extradition on 3 June and 29 October 1974 . The question whether the detention was lawful should be decided mainly in relation to Belgian law . However, contrary to what the applicant alleges, Belgian law does not place any obligation on the Minister of Justice to give a decision within 15 days of receiving the opinion of the court (Chambre des mises en accusation) . Section 3 of the Extradition Act of 15 March 1874 merely provides in the matter of time-limits, that "as soon as the alien has been imprisoned in pursuance of one of the decisions mentioned above (criminal judgment, arrest warrant, etc .) the Government shall seek the opinion of the indictments chamber of the appeal court (Chambre des mises en accusation) . . ." and that "within fifteen days from their receipt, the documents shall be returned, with the substantiated opinion, to the Minister of Justicé ' . It is thus clear from an examination of the file that during the period at issue the applicant was lawfully detained in accordance with Art . 5 111 (f), as extradition proceedings were in fact pending .
It follows that the complaint is manifestly ill-founded within the meaning of Art . 27 (2) of the Convention . 2 . The applicant also argues that his extradition was granted in violation of the Franco-Belgian extradition treaty as well as the Belgian Extradition Act of 15 March 1874 . However, extradition, like deportation, is not as such among the matters covered by the Convention, so that the complaint is incompatible ratione materiae with the provisions of the Convention within the meaning of Art . 27 (2) of the Convention . 3 . The applicant complains, finally, of failure to return to him the monies seized during the judicial investigation and of the slowness of the procedure relative to civil claims . The monies whose restitution the applicant is demanding are for a large part, after deduction of fines and legal costs, being held by the clerk of the court under a provisional order of attachment made by the attachments court at the request of various persons . This attachment is valid for three years (Article 1458 of the Belgia n

Judicial Code) . The monies have thus been temporarily frozen in connection with civil proceedings with a view to protecting the interests of persons injured by an offence . There can therefore be no question of a violation of the right to enjoyment of oné s possessions as guaranteed by Art . 1 of Protocol No . 1 (cf . mutatis mutandis, Application No . 5483/72 against the Netherlands, Collection 44, page 60) . As to the length of proceedings-a matter referred to in A rt . 6 ( 1)-one year has passed since the expiri ty of the time-limit laid down for the submission of civil claims and since the issue of a writ of summons ( "citation directé') by the civil claimants who were the first to act . It seems, however, that the judge adjourned the hearing iri the case at Ihe instance of the civil claimants with a view to facilitating a settlement of their claims as a whole . It is not apparent from the file that the applicant asked for a new time-limit to be fixed, so that he does not seem to have shown the diligence required of pa rt ies to the civil proceedings . Therefore, an examination by the Commission of the facts as presented does not disclose any appearance of a violation of the Convention, in pa rt icular of Art . 6( 1) thereof, or of Art . 1 of Protocol No . 1 . It follows that the application is in this respect manifestly ill-founded within the meaning of Art . 27 ( 2) of the Convention . For these reasons, the Commission
DECLARES THIS APPLICATION INADMISSIBLE .
