Article 5, paragraph 4 of the Convention : Even in the case of a very short detention, the arrested or detained person immediately enjoys, in principle, the safeguards of Article 5, para . 4. However, in spite of the absence of any local remedy, there is no violation of this provision if the detention ceases within a period shorter than that which would have been required for even a very speedy pmcedure in conformity with the conditions set out in this provision .

Summery of the relevant facts
Applicants X. and Y., Japanese citizens, are married and have one child. They have been living in Sweden since 1971 . On . . . September 1975 in the early morning, the Swedish Government, acting on the basis of the Terrorist Act (entered into force on I May 1973 and to a large extent incorporated in the Aliens Act as from 1976), decided to expel with immediate effect applicant X., suspected of belonging to a terrorist orgenisetion . At 10.30 a .m . he was arrested and was informed of the decision to expel him, in the presence of his lawyer . At 11 .45 a .m ., he was transferred to an airport in the area of Stockholm and put on a chartered aircraft which took off for Coaenhagen at 12 .15 p .m., where he was immediately put aboard an aircraft that left for Japan .

THE LAW (Extract ) The applicants have Ifinallyl alleged a violation of Art . 5(4) of the Convention in that the first applicant had no possibility of taking any court proceedings in order to have the lawfulness of his detention on . . . September 1975 decided . They have submitted that the detention continued also during the flight from Sweden to Japan as the applicant was accompanied by officers from the Swedish Secret Service Police . The Commission has first considered, ex officio, the applicant's deprivation of liberty under the provisions of Art . 5(1 ) (f) of the Convention, which read as follows : "Everyone has the right to liberty and security of person . No one shall be deprived of his liberty save in the following cases and in accordance with a procedure prescribed by law : (f) the lawful arrest or detention . . . . . . of a person against whom action is being taken with a view to deportation or extradition . " Insofar as the present case is concerned, the Commission has found that the applicant was arrested and detained in circumstances prescribed in the said provisions, and there is consequently no appearance of any violation of Art . 5 (1) of the Convention . The Commission has then examined the complaint under Art . 5 141 of the Convention which provides that : "Everyone who is deprived of his liberty by arrest or detention shall be entitled to take proceedings by which the lawfulness of his detention shall be decided speedily by a court and his release ordered if the detention is not lawful . " The respondent Government has inter alia submitted that such immediate execution of an expulsion order as in the present case cannot be considered to constitute arrest or detention within the meaning of Art . 5 (4) of the Convention . In the Commission's opinion the above provision seeks to secure judicial control of a person's arrest or detention with the ultimate aim of his being released if the arrest or detention is found to be unlawful . Thus, having regard to the object of Art . 5 141, it is the view of the Commission that every person deprived of his liberty has the right, in principle, to enjoy the guarantees laid down in this provision as from the moment of his being arrested or detained . The Commission observes that the so-called Terrorist Act did not provide a person deprived of his liberty by virtue of its provisions with any possibility whatsoever to have the lawfulness of his detention reviewed by a court of law . However, the Commission is not called upon to decide in abstracto as to whether this Act, as such, was conform to the requirements of the Convention, but only to examine whether or not its application to the applicant in the present case was inconsistent with Art . 5 (4) (cf . decision on the admissibility in Application No . 290/57, Yearbook 3, pp . 214, 220) . It then appears, in the first place, that the applicant was detained in Sweden during less than two hours on . . . September 1975 . It has furthermore been submitted however that he was being detained even in the aircraft which took him to Japan . In this respect the Commission refers to its decision on the admissibility in a similar case according to which the restriction of a person's liberty during his flight from the Netherlands to the United States was a lawful detention within the meaning of Art . 5 111 (f) of the Convention (cf . Application No . 1983/63, Collection of Decisions 18, p . 191 . However, even considering in the present case the time the applicant thu s

spent in the aircraft from Sweden to Japan, the Commission nevertheless finds that his deprivation of liberty for which the Swedish authorities were responsible ceased within a period shorter than that which would heve been necessary for the application of the procedure envisaged in Art . 5 (4) of the Convention . Even the most speedy procedure under Art . 5 (4) would take at least some hours . The Commission therefore concludes that, in spite of the absence of any local remedy by which the lawfulness of the applicant's detention could have been determined, he has not suffered any prejudice thereof which would amount to a violation of Art . 5 (4) . An examination by the Commission of this complaint as it has been submitted, including an examination made ex officio, does not therefore disclose any appearance of a violation of the rights and freedoms set out in the Convention and in particular in Art . 5 111 and (4) . It follows that [the remainder of] the application is manifestly ill-founded within the meaning of Art . 27 (2) of the Convention . For these reasons, the Commissio n DECLARES THIS APPLICATION INADMISSIBLE . Résumé des teits pertinents Les requérants X. et Y ., de nationalité japonaise, sont mariées et ont un enlent. lis étaient établis en Suéde depuis 1971 . . . septembre 1975 aux premiéres heures de la metinée, le Gouvernemen t .Le suédois, agissant en application de la loi sur le terrorisme (entrée en vigueur le 1• 1 mai 1973 et en grande partie incorporée à le toi sur les étrangers dés 1976), a décidé l'expulsion immédiate du requérant X ., soupçonné d'appartenir à une organisetion terroriste . A 10 h 30, X. fut enété et, en présence de son avocat, informé de la décision d'expulsion . A 11 h 45, il fut transféré vers un aéroport de la région de Stockholm et placé dans un avion spécial qui décolla à 12 h 15 pour Copenhegue, où il fut immédiatement installé dans un appereil qui partit pour te Japon .
(TRADUCTION) EN DROIT (Extrait ) Les requérants alléguent [en dernier lieu] une violation de l'article 5, par . 4, de la Convention en ce que le premier d'entre eux n'a pas eu la possibilité d'introduire un recours devant un tribunal afin qu'il statue sur la légalité de la détention qu'il a subie le . . . septembre 1975 . Ils font valoir que cette détention s'est poursuivie durant le voyage aérien de Suède au Japon, le requérant étant escorté par des agents des services secrets suédois . La Commission a d'abord examiné d'office sous l'angle de l'article 5, par . 1(f) , de la Convention la privation de liberté subie par le requérant . Cette disposition stipule « Toute personne a droit à la liberté et à la sOreté . Nul ne peut atre privé de sa liberté, sauf dans les cas suivants et selon les voies légales :

(f) s'il s'agit de l'arrestation ou de la détention réguliéres d'une personne pour l'empécher de pénétrer irrégulièrement dans le territoire, ou contre laquelle une procédure d'expulsion ou d'extradition est en cours . » En l'espèce, la Commission estime que le requérant a été arrêté et détenu dans les conditions énoncées par cette disposition et qu'il n'y a donc pas apparence de violation de l'article 5, par . 1, de la Convention . La Commission a examiné ensuite le grief tiré de l'article 5, par . 4, de la Convention, lequel stipule : « Toute personne privée de sa liberté par arrestation ou détention a le droit d'introduire un recours devant un tribunal, afin qu'il statue é bref délai sur la légalité de sa détention et ordonne sa libération si la détention est illégale . »
Le Gouvernement mis en cause a soutenu entre autres qu'une exécution aussi rapide qu'en l'espéce d'une décision d'expulsion ne comporte pas une arrestation ou une détention, au sens de l'article 5, par . 4, de la Convention . De l'avis de la Commission, cette disposition exige un contrôle judiciaire de l'arrestation et de la détention qui a pour but que l'intéressé soit libéré si l'arrestation ou la détention sont jugés illégaux . Etant donné l'objet de l'article 5, par . 4, la Commission estime que toute personne privée de sa liberté a le droit, en principe, de jouir des garanties contenues dans cette disposition dés l'instant où elle est arrbtée ou détenue . La Commission observe que la loi dite loi sur le terrorisme n'accordait aux personnes privées de leur liberté en vertu de ses dispositions aucune possibilité de faire examiner par un tribunal la légalité de leur détention . La Commission, toutefois, n'a pas à apprécier in abstracto si cette loi, prise en elle-même, est conforme aux exigences de la Convention, mais elle doit se borner à examiner si l'application qui en a été faite dans le cas du présent requérant était incompatible avec l'article 5, par . 4 Icf . décision sur la recevabilité de la requête N° 290/57, Annuaire 3, pp . 214, 220) . Il apparait en premier lieu que, le . . . septembre 1975, le requérant a été détenu durant moins de deux heures . Il a été soutenu, il est vrai, qu'il avait encore été détenu dans l'avion qui l'a emmené au Japon . La Commission se référe ici à sa décision sur la recevabilité d'une requête analogue, décision dans laquelle elle a trouvé que la restriction apportée à la liberté d'une personne pendant le voyage aérien des Pays-Bas aux Etats-Unis constituait une détention réguliére, au sens de l'article 5, par . 1 (f) de la Convention (cf . requPte N° 1983/63, Recueil 18, p . 19) . Cependant, méme si l'on prend en considération, en l'espèce, le temps que le requérant a passé en avion entre la Suède et le Japon, la Commission constate que la privation de liberté imputable aux autorités suédoises a pris fin dans un délai plus bref que celui qui eût été nécessaire au déroulement de la procédure visé à l'article 5, par . 4, de la Convention . En effet, la procédure la plus rapide qui répondit aux exigences de l'article 5, par . 4, aurait pris au moins quelques heures . La Commission en conclut qu'en dépit de l'absence en droit national d'un recours permettant de faire statuer sur la légalité de la détention du requérant, ce dernier n'en a subi aucun préjudice équivalant à une violation de l'article 5, par . 4 .
L'examen de ce grief par la Commission, tel qu'il a été présenté ou d'office, ne révéle donc aucune apparence de violation des droits et libertés énoncés dans la Convention, en particulier dans son article 5, par . 1 et 4 . Il s'ensuit que Ile restant de] la requbte est manifestement mal fondé, au sens de l'article 27, par . 2, de la Convention .
