Article 5, paragraphe 5, de la Convention : Cette disposition ne garantit un droit à réparation qu'aux personnes victimes d'une violation de l'article 5, paragraphes 1 à 4, de la Convention . Le seul fait qu'un tribunal reconnait, selon la loi nationale, le droit d'une personne qui a été détenue à recevoir une indemnité ne signifie pas que la détention était contraire à la Convention .

Résumé des faits pertinents
Le requérant a été arrété en mars 1974 comme soupçonné d'avoir contraint un mineur de méme sexe à des actes contraires A la pudeur et d'avoir détenu illégalement une arme à feu. En septembre 1974, il a été condamné à une amende pour détention illégale d'arme et acquitté pour le surplus. Le tribunal a reconnu au requérant le droit A une indemnité pour sa détention de mars à septembre 1974, conformément à la loi du 8 mars 1971, mais cette indemnité n aurait pas encore été versée.
EN DROIT (Extrait) Le requérant semble se plaindre LaussiJ de n'avoir pas reçu l'indemnité qui lui a été allouée le . . septembre 1974 par le tribunal de Berlin à la suite de sa détention préventive du . . mars au . . septembre 1974 . La Commission constate toutefois que rien dans le dossier ne permet de douter que le requérant ait été détenu, durant cette période, selon les voies légales, en vue d'étre conduit devant l'autorité judiciaire compétente parce qu'il y avait des raison s

plausibles de soupçonner qu'il avait commis une infraction . Sa détention était donc conforme aux dispositions de l'article 5, § 1 c), de la Convention . En outre, l'examen du dossier ne permet pas non plus de penser que le requérant ait pu étre victime d'une violation des droits que lui garantit l'article 5, §4 2 à 4 . La Commission relève que le simple fait que le tribunal de Berlin ait reconnu au requérant le droit à une indemnité pour la détention provisoire par lui subie n'indique nullement qu'il jugeait cette détention provisoire contraire à la Convention . En effet, l'article 2 de la loi du 8 mars 1971 (BGBI . I S . 157) pose le principe général du droit à l'indemnisation pour celui qui est acquitté après avoir été détenu provisoirement, sauf déchéance spécialement prévue à l'article 6 de ladite loi .
Or l'article 5, § 5, de la Convention ne garantit un droit à réparation qu'aux personnes victimes d'une violation de l'article 5 de la Convention . Comme il n'apparait pas que la détention du requérant ait été contraire à l'une quelconque des dispositions de cet anicle, l'article 5, § 5, ne lui garantit pas un droit à réparation . Il s'ensuit que le restant de la requête est également manifestement mal fondé, au sens de l'article 27, § 2, de la Convention .
Summary o f the relevant facts The applicant has been arrested in March 1974 on suspicion of having forced a minor of the sarne sex to commit acts contrary to public decency and of illegal possession of a fire arm. In September 1974, he was sentenced to a fine for illegal possession of arms and acquitted for the remainder. The court recognised the applicant's right to compensation for his detention from March till September 1974, in accordance with the Act of 8 March 1971, but allegedly this sum had not yet been paid.
TRANSLATION) THE LAW ( Extract) The applicant Calso] appears to complain that he did not receive the compensation awarded to him on . . September 1974 by the Berlin cou rt following his remand in custody from . . March to September 1974 . The Commission notes however that nothing in the file gives cause to doubt that the applicant was lawfully detained during that period in order to be brought before the competent judicial authority because there were grounds for suspecting that he had committed an offence . His detention was thus in conformity with A rt icle 5(1) c of the Convention . Nor does an examination of the file give any reason to think that the applicant may have been the victim of a violation of the rights enshrined in A rt icle 5 ( 2) -(4) . The Commission points out that the mere fact that the Berlin cou rt acknowledge d the applicant's right to compensation for his detention on remand in no way indicates that it regarded that detention as being contra ry to the Convention . Section 2 of the Act of 8 March 1971 (BGBI, I . p . 157) lays down the general principle that a person who is acquitted following remand in custody has the right to compensation unless that right is forfeited as provided for in Section 6 of the said act .

Article 5 (5) of the Convention secures a right to compensation only to persons who are victims of a violation of that Article . Since the applicant's remand in custody does not seem to have been contrary to any provision of the said Article, Article 5(5) does not secure for him a right to compensation . It follows that the remainder of the application is also manifestly ill-founded within the meaning of Article 27 (2) of the Convention .
