Summe ry of the relevant facts (français : voir p . 166) The applicant is a British citizen who is at present serving a sentence in the prison of P. . When he discovered that he would not be allowed to take part in the Referendum on the membership of the United Kingdom in the EEC which was scheduled for 5 June 1975 he petitioned the Home Secretary . His petition was answered to the effect that the Referendum Act of 8 May 1975 had in principle restricted the franchise to those entitled to vote at a generat election, and that under Section 4 of the Representation of People Act 1969 convicted persons detained in a penal institution in pursuance of their sentence are not entitled to vote.
THE LAW (Extract) 1 . The applicant believes that the refusal to allow a convicted prisoner to participate in a referendum (the British Referendum of 5 June 1975 on EEC membership) amounts to a violation of his freedom of expression as laid down in Art . 10 of the Convention.

It is true that Art . 10 of the Convention secures to every person the right to freedom of expression . However, in an earlier decision (Application No . 6573/74, D .R . 1/87) the Commission has already stated that in its opinion this provision does not guarantee the right to vote as such . The Commission now finds that the same is true with regard to the right to participate in a referendum such as the British Referendum on EEC membership . It follows that Art . 10 of the Convention is not applicable to the present case . 2 . The Commission, acting ex officio, has also considered the application in the light of Art . 3 of Protocol No . 1 . This provision reads : "The High Contracting Parties undertake to hold free elections at reasonable intervals by secret ballot, under conditions which will ensure the free expression of the opinion of the people in the choice of the legislature . "
The Commission recalls its earlier jurisprudence that this Article may be invoked by an individual in an application brought under Art . 25 of the Convention (cf . the Commission's decisions concerning applications No . 2728/66, Collection 25, p . 38, Yearbook 10, p . 338 and No . 6573/74, D .R . 1/871 . However, the obligations of the High Contracting Parties under this provision are limited to the field of elections concerning the choice of the legislature . The British Referendum on EEC membership was not an election concerning the choice of the legislature : It was of a purely consultative character and there was no legal obligation to organise such a referendum . It did not, therefore, fall within the scope of Art . 3 of Protocol No . 1 to the Convention . It follows that a right to participate in the referendum could not be derived from that provision either . Résumé des faits pertinents Le requérant est un ressortissant britannique détenu é la prison de F . lnrormé de ce qu'i1 ne pourrait prendre part au référendum du 5 juin 1975 sur le maintien de l'adhésion britannique aux Communautés Européennes, il a adressé une pétition au Home Office . Celui-ci lui a répondu que la loi du 8 mai 1975 portant organisetion du rélérendum avait repris les principes applicables en matiére d'élections générales et que, en vertu de l'article 4 de la loi de 196 9 sur la Représentation du Peuple, les personnes défenues aprés condamnation n'étaient pas autorisées à voter . (TRADUCTION) EN DROIT (Extrait) 1 . Le requérant estime que l'interdiction faite à une personne dAtenue en exécution d'une condamnation pénale de participer à un référendum constitue une violation de son droit à la liberté d'expression, garanti par l'article 10 de la Convention . Il s'agit en l'espèce du référendum britannique du 5 juin 1975 relatif à l'adhésion aux Communautés Européennes . L'article 10 de la Convention garantit, il est vrai, le droit de tous à la IibertA d'expression . La Commission a cependant déjà constaté, dans une décision antérieure, que cette disposition ne garantit pas le droit de vote en tant que tel (Requ®te N° 6573/74 . D .R . 1/87) . La Commission considère qu'il en va de mime du droit de participer à un référendum, tel le référendum britannique sur l'adhésion aux Communautés Européennes .

Il s'ensuit que l'article 10 de la Convention n'est pas applicable en l'espéce 2 . La Commission a également procédé à un examen d'office de la requête sous l'angle de l'article 3 du Protocole additionnel, qui dispose : a les Hautes Parties Contractantes s'engagent à organiser, à des intervalles raisonnables, des élections' libres au scrutin secret, dans les conditions qui assurent la libre expression du peuple sur le choix du corps législatif » . La Commission se réfère à sa jurisprudence antérieure selon laquelle cette disposition peut étre invoquées par une personne physique dans le cadre d'une requête introduite conformément à l'article 25 de la Convention (cf . Décisions de la Commission relatives aux requêtes N° 2728/66, Rec . 25, p . 38, Ann . 10 p . 338 et N° 6573/74, D .R . 1/87) . Toutefois les obligations assumées par les Hautes Parties Contractantes en vertu de cette disposition sont limitées au domaine des élections législatives . Or, le référendum britannique sur l'adhésion aux Communautés Européennes ne constituait pas une élection relative au choix du corps législatif . Il s'agissait d'une simple consultation dont l'organisation n'était nullement obligatoire en droit interne . Ce référendum ne pouvait dès lors être visé par l'article 3 du Protocole additionnel à la Convention . Un droit quelconque à prendre part à ce référendum ne pouvait pas davantage être déduit de cette disposition .
