When public auction of property has been ordered, section 283(5) of the Uniform Act
on Ac Af Ab and Measures of Execution provides that where no bid is made after three candles have been successively lit, the pursuing creditor shall be declared winner for the set up price, save where he requests that the auction sale be put off for another hearing for a new set up price. Section 283 UASRPME (High Court of Aa BAdA, AGUH KUM Lucy v. NDE FRU Eric, suit no HCB/02S/2010 of 23 October 2012)
The section for the auction sale of immovable property commenced at 10.30AM on the 23rd day of October 2012. The learned counsel for judgment creditor moved the court for the sale, and indicated the date of the publication of the sale of the property and tendered proof of same publication. He further submitted that the debt balance is in the sum of sixteen million two hundred and twenty seven thousand, six hundred and fifty two FCFA (16.227.652 FCFA); which is equally the reserve price. The court admitted the bailiff’s report of publication and labelled same as exhibit A. The cost of the proceedings as ordered at the eventual hearing was reiterated to be in the sum of one million FCFA (1.000.000).
The court ordered the lord sheriff-bailiff to proceed with the sale of the land covered by land title number 6390 of Mezam vol. 32 folio 129 situate at Ae in the Ae subdivision in the name of NDE FRU Eric.
The bids were ordered to be indicated in the sum of one million FCFA. At the extinction of three successive candles no bids were tendered.
ORDERS
1) THE COURT, HAVING OBSERVED THE EXTINCTION OF THE 3RD CANDLE WITH NO BIDDERS FOR THE PROPERTY WHICH IS THE OBJECT OF THE AUCTION SALE; ADJUDGES THE PROPERTY IN FAVOUR OF THE PURSUING CREDITOR, AGUH KUM LUCY.
2) THAT THIS JUDGMENT BE SERVED ON ANY OCCUPANTS OF THE PROPERTY COVERED BY LAND CERTIFICATE N° 6390 OF MEZAM VOL. 32 FOLIO 129.
3) THAT ANY OCCUPANTS OF THE PROPERTY IN ISSUE SHALL BE FORCEFULLY EVICTED WHERE NECESSARY.
4) COST OF THESE PROCEEDINGS SHALL BE IN THE SUM OF ONE MILLION AND SHALL BE PAID BY THE JUDGMENT DEBTOR.
5) THAT COST OF THESE PROCEEDINGS SHALL BE A PRIVILEGED CLAIM FROM THE PRICE OF THE SALE.
6) THAT THE LANDS REGISTRAR FOR MEZAM IS HEREIN ORDERED TO TRANSFER THE TITLE OVER THE LAND COVERED BY LAND CERTIFICATE PRESENTLY IN THE NAME OF NDE FRU ERIC N°6390 TO PURSUING CREDITOR AGUH KUM LUCY.
